The state information commissioner for Pune has imposed a fine of Rs
6,000 on a clerk of the Pimpri-Chinchwad Municipal Corporation (PCMC)
for not giving information sought under the Right To Information (RTI)
Act within the stipulated time. The fine will be recovered from the
clerk's salary in three months.
State information commissioner, Pune bench, Vijay Kuvalekar in his
recent order imposed a fine of Rs 250 per day for the delay of 24 days
on clerk Sanjeevani Kamble. The fine has to be recovered from the
salary to be paid in November and December (2010) and January (2011).
The information commissioner has directed city engineer Eknath Ugile
to recover the fine and submit a compliance report.
Social activist and president of Sangvi unit of the Maharashtra
Navnirman Sena, Raju Savale, had on October 20, 2008, submitted an
application under the RTI Act to get information from zone D office of
the PCMC. The application was received by the public information
officer on the same day. The engineering department after receiving
the application on November 1, 2008, sent the requisite information to
zone D on November 18.
During the hearing of his first appeal on December 24, 2008, Savale
said he had not received the information, which was then handed over
to him. R D Suryavanshi, representative of M D Nikam, executive
engineer, zone B, said some more information had been given during the
hearing on special appeal.
Kuvalekar had given directives to appellate officer and city engineer
Ugile to submit a report after inquiring into who was responsible for
delaying the information by 24 days, after the lapse of the 30-day
period stipulated under the RTI Act to give out information on an
original application. Ugile submitted a report on August 7, 2010,
saying that as per records clerk Kamble was responsible for it.
The Right to Information Act 2005, is the biggest fraud inflicted upon on the citizens since the Nehru-Gandhi family.
