Dear Madam,

This has reference to my on going complaints against IAS Officers known for committing serious irregularities, intentional derelction of duty to save well known corrupt IAS Officers and thus being part of corruption and encouraging corruption at high level.

Biased & unethical IAS Officer Shri P D Sudhakar as CVO MCA GOI New Delhi, despite my written requests followed by umpteen no. reminders, did not investigate CVC registered complaint against known corrupt IAS Officer Shri Jitesh Khosla. 

Shri P D Sudhakar was also not considered fit to work as Secretary Parliamentary Affairs.

However, he is reportedly selected by some unknown committee, in an undemocratic, clandestine and secret manner, without inviting applications by Public Notice, for the post of Head DERC.

A bureaucrat known for his biased, corrupt & unethical working cannot be expected to justice while heading DERC. 

In view of the above, kindly arrange to stop Shri P D Sudhakar from taking over as Head DERC not being in larger public interest. Shri P D Sudhakar should also not be considered for any public post hereafter considering his non-so-good past working.

Timely intervention of the President of India Secretariat in stopping irregularities in such appointments may also save the President of India from the unpleasant work of cancelling appointment order like that of Shri P J Thomas as CVC.

You may like to prevail upon the UPA Govt to go for transparent, non-arbitrary and democratic selection of DERC Head or any other such Key Positions rather than giving largesse to retired bureaucrats.

This has reference to the media news on Mr P D Sudhakar to be Secretary Parliamentary Affairs.

This has also reference to my complaint on corrupt practices / serious irregularities committed by Mr Jitesh Khosla abusing position and approving BRPL-IOC Merger.

My complaint against him registered by CVC is still pending and NOT investigated by Mr P D Sudhakar as CVO in MCA GOI to protect corrupt Mr Jitesh Khosla.

I, therefore, strongly object to Mr P D Sudhakar becoming Secretary Parliamentary Affairs till my complaint reaches logical conclusion.

In larger public interest, the victim of corruption and Whistle Blower hereby requests your kindself to stop Mr P D Sudhakar becoming Secretary Parliamentary Affairs.

Further, your kind attention is invited to the last hearing in the matter took place on 7th November 2008 and the last interim order dated 19th November 2008 pronounced by you. It is placed at - 


Your kind attention is also invited to the Supreme Court judgment in Anil Rai vs State of Bihar dated 6th August 2001 on inordinate delay in pronouncing judgment after the hearing was over long back.The said judgment is placed at - 


The following is quoted from the said Supreme Court judgment. 

"The magistrate who cannot find time to write judgment within reasonable time after hearing arguments ought not do any judicial work at all. This Court strongly disapproves the magistrates making such a tremendous delay in the delivery of his judgments"

"Nevertheless an unreasonable delay between hearing of arguments and delivery of judgment, unless explained by exceptional or extraordinary circumstances, is highly undesirable even when written arguments are submitted. It is not unlikely that some points
which the litigant considers important may have escaped notice. But, what is more important is that litigants must have complete confidence in the results of litigation. This confidence tends to be shaken if there is excessive delay between hearing of arguments and delivery of judgments"

Kindly be informed that you have been biased throughout; you have granted outright favour to the petitioner Companies in the matter of disposing off the applications; you have not declared the Sundry Creditors' Meeting of IOC as Null & Void though it was vitiated due to physically and illegally stopping me & other creditors from attending the Meeting; you have discriminated the objectors; you have allowed the counsel of the petitioner Companies to abuse the objectors in the open court & not stopped her; you have harassed and tortured the objectors; you have not pronounced all orders in open court as is required; you have singularly discriminated me by not directing the petitioner Companies to file reply to my objections while replies to other objectors have gone long back; you have violated my fundamental right to get free legal aid; you have preferred to ignore my appeal to direct the petitioner Companies to go for compromise with me since they have no answer to the objections filed by me; you have not given your verdict on my application to summarily dismiss the petition since they have not filed any reply to my objections; the petitioner Companies have not filed any written reply in response to your interim order of 19th November 2008 despite your giving an opportunity to them to file reply by 21st November 2008;  you have favoured the petitioner Companies by intentionally delaying the disposal of my appeals and facilitated the Board of Directors of Indian Oil Corporation Limited to continue with the arbitrary, illegal, unethical and criminal activities in the HR area of issuing promotion and transfer orders without codified / transparent policies in violation of the Supreme Court judgment in Dev Dutt vs Union of India & Ors.; you have not directed the petitioner Companies to produce, as requested by me, the supporting study data that confirms that the amalgamation of Govt Companies done earlier indeed achieved the stated objectives; you have preferred not to make Ministry of Petroleum& NG and Cabinet Secretary as a party to this amalgamation of the Govt Companies; you have preferred to ignore even the advice of the Senior Counsel representing petitioner Companies to refer the jurisdiction issue to the High Court / Supreme Court for settling it; you have acted in an arbitrary, unreasonable and unfair manner; you have seriously violated the principles of natural justice; you have preferred to continue to hear the matter when the objectors have already expressed loss of faith in your impartiality and integrity & you should have long back recused  yourself from hearing the matter but you have  preferred to continue to hear this amalgamation petition for the reasons best known to you. 

Not surprisingly then that there are large no. of complaints against you to the Cabinet Secretary to the GOI, Central Vigilance Commission and even President of India. Copies of the complaints already marked to you.

Further to the above and despite telephonic / email / written reminders to you to hear the matter in open court, give fair opportunity to all and pronounce order in open court after your last interim order on 19th November 2008, you have preferred not to respond / not conveyed your decision so far.
 
Further even after the reported extension of three months granted to you on completion of your five year tenure at MCA on 20th January 2009, you have preferred to maintain silence.

Considering the above aspects and considering the Supreme Court judgment in Anil Rai vs State of Bihar referred to above,you have no rightful or moral authority to pronounce any order in BRPL - IOC amalgamation and request you to kindly refrain from passing any order particularly when you have limited days as JS MCA New Delhi.

During one address and interaction by CVO IOC New Delhi with we officers at IOC WR Mumbai few years back,  I conveyed my observation "Delay breeds corruption, not necessarily in cash in kind."  He readily agreed with my observation and told that he would take up the matter with Director (HR) IOC.

That was in connection with arbitrarily deciding VRS applications of IOC officers by IOC management. Some applications were cleared within a couple of weeks to favour few selected while other applications were kept pending indefinitely in a high-handed manner even though required to be disposed off within three months and thereby inflicting mental torture and agony on the concerned officers.

By keeping no. of my complaints for the last few years pending / not following up them, after the matter is referred to the CVO of concerned Ministry / Department, for reaching to their logical conclusion, the Commission is allowing the corruption to breed but it needs to stop. 

You may kindly look into all those cases. If the Commission is satisfied that those cases should be closed, let them be closed with reasoned orders.

In the present case, you may like to ask Mr. P D Sudhakar, CVO and Additional Secretary to GOI, MCA, New Delhi on action taken on reference from the Commission and on my written requests / reminders to him. If no action is taken then it is high time that it is taken.

Dear Sir,

As per your order dated 24th October 2008, the counsels for the petitioner companies were directed on 20th October 2008 to file replies within two weeks from the date of order to all outstanding objections including mine.

It has been more than two weeks and I have still not received any reply, under affidavit, to the objections filed by me and transmitted to the counsels on email as well as via post. The objections have been filed by me on oath since 19th August 2008.


Counsels
of the petitioner Companies have filed replies to other objectors but none to me during the last more than 2 1/2 months.

It is self-evident that the petitioner companies have nothing to say against the issues / objections raised by me. The issues / objections have not been contested by the companies either.

In view of this, my prayer to dismiss the company petitions be granted without any further hearing on the same principle as you had applied while disposing of my application for Legal Aid.

Without prejudice to it and in the alternate, the petitioner company Indian Oil Corporation Limited be directed to reach an amicable settlement / compromise on all the pending issues / objections raised by me.

y a copy of this email, the counsels of the petitioner companies are being requested  to send me their offer for reaching the settlement / compromise. In the absence of compromise the petition filed by IOC be dismissed. This is without prejudice.

The issues involved are:
  • Furnish study data to confirm that the amalgamations of Oil PSUs done earlier achieved the stated objectives of the amalgamations. This has a strong bearing on the amalgamation of BRPL - IOC.

  • Long pending codification of transfer policy for officers and workmen of IOC in terms of CVC Guidelines of 1999 & making available their copies to me.

  • Codification of promotion policy for officers of IOC (Deputy Manager & above) in terms of CVC Guidelines of 1999 & making available their copies to me.

  • My requests for inclusion of two excluded areas in Indian Oil Grievance Handling Procedure pertaining to (a) performance rating (b) promotion for officers. The four decade old policy is a serious violation of the fundamental right to justice and  Mr Sarthak Behuria Chairman IOC is sitting on it since September 2006.

  • Immediate suspension of Mr V C Agarwal, Director (HR) IOC in view of his misuse of authority / acting in a high-handed manner / threatening me / getting me chargesheeted and suspended for my using the Right to Information Act 2005 & writing emails seeking justice. Also taking into account the complaint against him by Indian Oil Officers Association to Chairman IOC vide letter dated 2nd November 2007. Copy enclosed.

  • Immediate suspension of Mr J S Kaushal, DGM (HR) IOC Mumbai who reportedly ran behind a girl in a Daman Hotel and complaints against whom have all along been ignored by IOC.

  • Issuance of chargesheet to Mr G C Daga, Director (M) IOC for unauthorised / out of jurisdiction / illegal / unethical / malicious / atrocious enquiries No. IR/1461/W-166 & IR/1461/W-202 against me for my using the Right to Information Act 2005 and sending emails to various authorities.

  • Issuance of chargesheets to Mr Satish Kumar ED (HR) IOC; Mr A K Rauniar, the then ED (HR) IOC; Mr S K Gupta the then GM IOC IOC Ahmedabad & Mr P K Julka, GM (Planning) IOC HO. Kindly refer to my complaints pending with IOC.

  • Issuance of chargesheet to Mr S K Awasthi, the then Sr Area Manager IOC, Nagpur for misappropriating IOC funds for Oil Conservation. Kindly refer to the enquiry report that I submitted nearly six years back & also refer to the notings by Mr P Banerjee the then ED, WR, IOC Mumbai on the complaint that was filed against Mr S K Awasthi by his junior on depositing the misappropriated money by way of DD  to IOC.

  • Issuance of chargesheet to Mr Raju Rangnathan, Company Secretary, IOC for illegally preventing me from attending Sundry Creditors Meeting of IOC on 22nd February 2008 when I had been a Creditor on the date of reckoning and my illegally withheld Bonus for the year 2006-07 was paid only three days prior to the meeting of Sundry Creditors of IOC on 22nd February 2008 on my objecting to the BRPL - IOC amalgamation.
  • Declaring all the enquiries against me commencing from 2002 till date, all of them for my writing emails, withdrawn and as Null & Void.

  • Withdrawal of the Legal Notice dated 12th June 2008, issued to me by the advocate of IOC for writing emails in 2005 / 2006 / 2007, unconditional apology by Mr Sarthak Behuria Chairman IOC for doing it and an undertaking that no Legal Notice like this would be initiated against me by IOC.

  • Posting of IOC officers in line with the Wish List that I handed over to Mr S K Gupta the then GM IOC Ahmedabad during personal discussion, arranged at the insistence of Mr S K Gupta, with Mr J S Kaushal, DGM (HR) IOC WRO in 2006 at IOC GSO Ahmedabad.

  • Donation of Rs 11 Crores, to NGOs like Pardarshita / Uday Foundation etc. doing social service (subject to the willingness of the concerned NGOs to accept the donation) towards compensation to me for threatening me / harassing me / chargesheeting me repeatedly for writing emails / suspending me twice / stopping my increments in a high-handed manner/ victimising me / withholding my dues illegally / delaying payment due to me / not protecting me as a Whistle Blower / not giving me office cabin and making me work for 2 1/2 years from my residence as a Senior Manager / deprieving me of my well-earned & well-deserved promotions by arbitrary and illegaly downgrading my performance / showing me in poor light by outright wrong information about me to various GOI authorities and also on IOC Website & torturing me for the last more than six years on my commencing writing emails, effective 7th May 2002,  seeking justice .

  • Furnish pending RTI information for 37 RTI complaints / second appeals against IOC that I filed with CIC in 2005-06 and are still lying with Prof M M Ansari, IC, CIC, New Delhi.

  • Payment of legal fee services of Rs One Crore to my legal advisors.

  • Restoration of illegally withdrawn Post-Retirement Medical Attendance Facility for my wife and myself. Apology to my wife for making her suffer for no fault of her.

  • Payment of my illegally withheld amount of Rs 50,000/- towards home desktop PC for the last more than three years.
