I am not much delighted with that judgment although ,, as the ground reality is different ,, this is not a new pronouncement at all . even the provision did not give any room for preliminary inquiry... so many judgments earlier also SC said so .. still police resort delay tactics and some kind of preliminary inquiry .. in fact no need to conduct any preliminary inquiry before registering FIR this is new found thearoy forwarded by police and approved By SC now .. dont think expect any change in the approach of the police even after this judgment as in Delhi at least they don't have any man power to register and investigate at least 25% of the complaints ..forge about registering FIRs... given the man power and the system in the police establishments nothing will change .... no action will be taken against the police officers as the authority under the rules is the superior police officers ,, serious allegations against the police officers are also being ignored by the superior officers..........

The category of cases in which preliminary inquiry may be made areas under:(a)Matrimonial disputes/ family disputes(b)Commercial offences(c) Medical negligence cases(d)Corruption cases(e) Cases where there is abnormal delay/laches in initiating criminal prosecution, for example, over 3 months delay in reporting the matter without satisfactorily explaining the reasons for delay.The aforesaid are only illustrations and not exhaustive of all conditions which may warrant preliminary inquiry.(vii) While ensuring and protecting the rights of the accused and the complainant, a preliminary inquiry should be made time bound and in any case it should not exceed 7 days.
