On behalf of the AGGRIEVED members of the "Humjanenge" RTI mailing lists, having
13,968 subscribers, of which I am a Moderator, I am constrained to
report / suggest as follows, in the larger public interest.
That the latest minutes of CIC's meeting of 24.07.2012 published
refers to the Judgment of the Delhi High Court in WP(C) 13090/2006
popularly known as the "C.Ramesh matter".
It appears that the Commission was not represented or VERY POORLY
REPRESENTED in such a serious matter concerning the inherent powers of
the Commission.
The citizens are aggrieved that CIC did not defend itself, or defended
itself so poorly.I recall that in 2006 when this matter was being
filed, there was hardly any budget allocated to fight cases resulting
in
this sorry situation today. Kindly take all steps to ensure that the
Commission's powers and autonomy are vigorously defended and
protected, and that SUCH POOR QUALITY and INDEFENSIBLE DECISIONS OF
THE CIC.are not allowed to occur again.
I may also mention that the CIC's decision of 2006 was personally
drafted by Mr. Prashant Bhushan (although signed by Mr Habibullah with
token modifications) and the CIC hjad no recourse but to allow him to
defend it in the higher forum.
I therefore call upon you to ensure that the regular (and illegal)
practice in CIC of allowing "winning" parties to write up drafts of
their orders should be stopped immediately.
