The thing you have not understood is "appeal"

CPIO denies information on ground that case is sub-judice .
FAA denies on same ground.
2nd appeal is in challenge that circumstances have changed.
This is not fit grounds for appeal
The Appellant has rightly been advised to file a fresh request.
