[IAC#RG] Complaint of FRAUD and CORRUPTION on citizens of Delhi in matter of WiFi

Dear Ms. Biswas / Mr. Das

I refer to the email from your office 12.May.2015 and am shocked by later press reports dated 24 May 2015 (quoting unnamed senior government officers) indicating that GoNCTD is proceeding with WiFi in Delhi scheme

I would have hoped that the GoNCTD would have reconsidered its unwise decision to hastily proceed with this scheme without proper public a
ccountability and transparency,

Accordingly I am complaining as follows.

1) That vide MHA order dated 24.11.2014 Mr.Arun Baroka,Secy (IT)/GoNCTD ought to have been transferred long ago to Andaman and Nicobar UT on 15 Feb 2015, but is somehow staying on in Delhi through "lobbying" and by acquiesing in and notifying some highly improper actions of present Chief Minister of Delhi and his Cabinet, such as

a) Notification of Delhi Dialogue Commission (In his capacity as Secy/AR)
b) Promotion of WiFi in Delhi scheme (In his capacity as Secy/IT)

I am also given to understand from DoPT website that Mr. Arun Baroka is on superannuation.

2) That after its formation, the so-called Delhi Dialogue Commission (which incidentally has plagiarised the term "Delhi Dialogue") had appointed a 3 member "expert" task force to implement a supposedly "free" Wifi in Delhi scheme.

I am aggrieved that the members of this so-called "expert" task force of Delhi Dialogue Commission were deliberately and secretly selected by Chief Minister of Delhi to ensure that they have no or few (known) formal technical qualifications to be described as "experts" for this highly technical venture involving hundreds of thousands of crore rupees in prospective licence fees.

For instance from the Internet I learn about its members that
a) Mr. Pranesh Prakash is apparently an Arts graduate,
b) Mr. Mahesh Murthy is apparently a college dropout
c) Mr. Nikhil Pahwa seems to be qualified from online websites like Coursera.

3) That I had responded to a public notice inviting comments from stakeholders in Delhi, issued by Secretary/IT, on WiFi in Delhi scheme and I was thus invited to a so-called stakeholders consultation on 27 April 2015 in GoNCTD Secretariat Bldg which I attended.

However, I was shocked to find that the technical proceedings of this consultation were actually being conducted by one Mr. Adarsh Shastri whereas Mr. Arun Baroka/Secy/IT/GoNCTD was sitting like a dummy throughout and in fact Mr. Baroka left the proceedings midway and the session was shortly terminated without substantive discussions. In other words the so-called stakeholders consultations were a fraud publicly conducted inside official GoNCTD premises by an imposter in Secy/IT's presence.

I am therefore aggrieved that Mr. Adarsh Shastri is not a government officer and had absolutely no business being present at the session or being allowed to conduct the proceedings to which I was invited or even to have had access to my comments submitted to Secy/IT/GoNCTD..

It is also not known to me what technical qualifications Mr. Adarsh Shastri possesses to moderate such a highly technical and controversial subject or to sit above myself while dissecting it. It seems that whereas Mr. Adarsh Shastri widely misrepresents himself as having a "MBA degree", his formal technical qualifications, if any, are unknown.

4) I am further aggrieved by press reports that the Wifi technology being considered effectively has a limited range of around  50 meters per node. It could thus conceivably take around 500 nodes/Access devices/Towers per sq.km of coverage, and need around 5 lakh such nodes/towers to cover the public areas/spaces of Delhi. The annual licence fee set by DoT is around Rs. 20 lakhs from each user of a co-sited static radio transmission tower. The operators of the backhauls would also gain by huge amounts by providing such kind of internet services. The "lost" revenue from 5 lakh WiFi nodes is likely to be considerable, and explains why officers like Mr Arun Baroka are not being transferred out of Delhi.

I would therefore request you to kindly inquire into my complaint/s and ensure that there is no hanky-panky in this WiFi scheme which entails a) loss of revenue to GoNCTD or any municipal corporation  b) wrongful gain in/of public property/spaces to private persons/entities c) any other loss / wrongful gain, d) all persons involved in approving this scheme are properly qualified.

NB: It is trite to mention that telecommunications is a Union list subject and role/motive of Shri Arvind Kejriwal's Cabinet for providing highly valuable commercial internet resources to the public "free" needs to be properly explained and investigated.

Citizenship Act,1955 has not yet been accepted by Government of India and the State Governments.
The judges are not law makers.
How many people of this country has signed the documents called Citizen of India format designed by the bureaucracy.It was proposed in the year 2004.
Therefore please do not blame the judiciary.

Remember. In India LAW simply means
    Leave Accused if Wealthy.
It does not stop with actors, politicians
bureaucrats and the like. It is not the mistake of the judges. Advocates should not take up cases they know to be unjust or illegal. Finding a way to somehow save their client is not fair. They no doubt save the client; but in that process ruin the moral fibre of the nation. The only way a common man can show his displeasure is by social boycott. If you do not agree with the let away culprit, don't see his movies for ever; or don't buy the product the cricketer endorses ; or don't vote for the party the politicians belong to. Ganga may not be cleaner by then. The country will become cleaner.

Till now the country has been ruled by the bureaucrats, our servants, who have a duty to serve us, not rule. My intention was not to compare the justice delivery in the two countries.
Our system is based on the british model ( Common Law). They made the laws as an imperial power to govern India and we adopted them  and have continued . But the population today is 5 times and the infrastructure has not kept pace.Let us say it is the democratic system. But if you look around how will you judge the success or failure of this system?The next democratic country with large population is US Where population is only 1/5 of India and infrastructure facilities are huge.
In the Muslim countries they follow the Shariat laws which are short and swift.
In the Communist countries-say China with comparable population and Russia the justice delivery system is swift not with 4/5 appeals from Trial court to Supreme Court.
So the question is with such a huge [population and limited resources,what should be the system to ensure timely,corrution free justice delivery ?

I am sorry to say that we are being unduly harsh on the judges forgetting the limitations under which they have to work.
Advocates are a part of the judicial system and why are we not blaming them for the delay and corruption?
Police are a part of the judicial system and why are we not blaming them for the delay, manipulation and corruption?
Govt. is a part of the judicial system as most of the cases of monetary nature-incometax, Sales tax, Excise, financial frauds originate from them and they keep on going into appeals in a routine manner-just clogging the judicial system.
We ourselves have become a litigant nation- and rush  to courts at the earliest opportunity without exhausting alternative
redressal mechanism. marital disputes, property disputes, inheritance and domestic violence fall into this catagory.
For infrastructure facilities in courts-the judiciary depends on the executive for funds. See the budget allocation for this.
The laws are made by the legislature. See the competence of the legislators for enacting laws which are clear, concise and not open to different interpretations. The judiciary has to act under that legal system.
For redresal of grievances against the Govt.,the judiciary developed the concept of Public litigation(PIL). You have to see the Nos of PILs being filed in Superior courts-many of them frivolous in nature and how much time the courts have to devote on the PILs
To my mind the main culprit is the Govt. who have been promising more that what they can deliver to the people,leading to frustration and sense of hopelessness.

YES,   IT IS ABSOLUTELY TRUE WHAT YOU OPINED ABOUT JUDICIARY IN INDIA.
   OUR  JUDICIAL SYSTEM IS NOT FUNCTIONING FAIRLY  FOR COMMON MAN, FOR
POOR PEOPLE, AND FOR HONEST PEOPLE.   MOREOVER  A TIE AMONG JUDGES,
SOLICITOR FIRMS, COUNSELS, POLITICIANS, INFLUENTIAL PERSONALITY, NAMED
AND FAMED ACTORS AND ALL SUCH LOBBY WITH THE HELP OF MONEY POWER  IN
WHOSE FAVOUR THE COURT DECIDES   AND 80% OF PEOPLE OF INDIA NEVER GET
JUSTICE IN TIME.      COMMON PEOPLE AND POOR HAS NO MONEY TO PAY
ENORMOUS FEES  TO ADVOCATES TO GET JUSTICE.      EVERY ONE KNOWS THAT
FACE VALUE OF COUNSEL AND NAME OF SOLICITORS' FIRM  COUNTS AND NOT A
MERITS OF THE CASE.      FURTHER  MANY POLITICIAN THOUGH INITIALLY
COME FROM COMMON MAN  SOCIETY BUT AS SOON AS HE OR SHE CHOOSES ANY
POLITICAL PARTY AND START GETTING HOLD IN PARTY BY DOING CORRUPT
PRACTICE TO COLLECT MONEY AND TO PROVIDE HUGE FUND TO THE POLITICAL
PARTY AND ON THAT MERIT ALONE HE SUCCEED TO GET TICKET FOR M.P. AND
M.L.A SEAT AS NOW ALL AWARE OF THIS FACT AND THEN THEY START  MAKING
CORRUPT THE ENTIRE ENVIRONMENT IN COUNTRY.    HOW PEOPLE CAN EXPECT
ANY HELP FROM SUCH SELFISH, RUDELY BEHAVED AND CORRUPT  POLITICIAN
WHO JUST WANT TO ENJOY THEIR LIFE AT THE COST OF TEX PAYER'S MONEY IN
INDIA.        HOW SUCH ARROGANT POLITICIAN    WILL BRING DEVELOPMENT
OF INDIA  AND BRING ACHHE DIN  FOR PEOPLE OF INDIA?    HOW PEOPLE PUT
TRUST IN SUCH GOVERNMENT THAT SUCH POLITICIANS WILL WORK HARD AND
PROVIDE SELFLESS SERVICE TO THE NATION AND MAKE LIFE OF PEOPLE OF
INDIA HAPPY AND PROSPEROUS?   PEOPLE Of  INDIA LOST INTEREST IN SUCH
SHAMELESS, CORRUPT AND ARROGANT POLITICIANS AND TIRED OF SUCH  INDIAN
DEMOCRACY WHERE NO HOPES LEFT FOR THE GOOD DAYS OF THE PEOPLE.  B.J.P.

B.J.P. PAST AND PRESENT MINISTERS AND PRESENT MINISTERS AND M.P. AND
