Re: [HumJanenge] IMPORTANT MAIL: Group moderating policy for February 2011

Good...
I think we are living in democratic world not autocratic. I firmly believe only mail related to RTI should be posted here but even if moderator want to reject any postings, that should be reviewed and in proper appropriate language should be refused.

When all member whoever posted mail in response of Mr. Roy's posting condemned the language, their voice shouldn't be left unheard.

Re: [HumJanenge] CIC to weed out (DESTROY) all case files after 6 months

Retention of public records  falls under the Public Records Act. There is a records officer who decides the retention policy for documents.

Some issues:

1) RTI Act allows for citizens to apply for records after 20 years, and the SHALL be provided.

2) If somebody demands a certified copy, then he has the right to compare it to the original. If the original is destroyed then the digital fascmile has no evidentiary value
and a certifed copy cannot be given (must check out the Information Technology Act again for this).

3) The documents in the files are Intellectual property of the parties.

4) Under the Public Records Act, only "ephemeral" documents can be weeded out.

Is this decision relates to those cases which stand solved to the satisfaction of the appellant?

Is this decision relates to those cases which stand solved to the satisfaction of the appellant?

I have case decided by Mr. Sharma on 31.03.2009 and asked DDA to supply me information within 10 days
but so far information has not been supplied by the DDA despite writing to DDA vice-Chairman and hairman also.
The matter was simultanously taken up to Chief Information Commissioner Mr. Wajahat Habibullah and his successor
Mr. A. N. Tiwari besides Mr. Sharma. What will be the fate of this CIC order of 31st March, 2009?

Another case was filed by me on about FIVE Nmonths back. No date of hearing has been fixed. There is no hope for next
2-3 months of its hearing. What will be the fate of this case also?

[HumJanenge] IMPORTANT MAIL: Group moderating policy for February 2011

To all dear H-J members,

In past 1 month the moderators are focussed on maintaining 300 email limit to this group. In January 2011 about 564 emails were posted to group and 296 emails have been circulated / allowed so far.

To ensure that nobody complains that dissenting emails are not censor, only crticising emails were allowed. This has given wrong impression that 1 senior moderator has no supporters.

We are also seeing that HJ-GG is #1 RTI e-group. RTI4EMPOWERMENT-GG is #2 e-group in terms of messages posted. So from next month (1, FEBRUARY 2011) there will be some new procedures to ensure that there is full and balanced discussion.

1) ONLY THOSE MEMBERS WHO CONSISTENTLY CONTRIBUTE POSITIVE OR IMPORTANT MESSAGE POSTS ON RTI WILL BE RETAINED ON THIS GROUP.

2) MEMBERS WHO CROSSPOST SHALL BE EXPELLED WITHOUT NOTICE.

[HumJanenge] Chalo Assembly- Long March from Nandurbar to Mumbai(500km.)

hi,

some points to be made  in SHORT

1 all over the world, there are people/countries  visibly expressing resentment of LEADERS exploiting them-  cairo, arab world, swiss banks, wikileads, etc
2. even here there are sporadic outbursts of resentment of leaders including the groups headed by I AM HONEST but DONT ASK ME ABOUT MY ASSOCIATES impotent men.
3. we have the villains holding out agitation WE OPPPOSE CORRUPTION in the parliament and assemblies.
4. we had a demonstration last in Bangalore AGAINST CORRUPTION.

Now we the GANDHIGIRIS should start a OPEN BUNDH, where we will ask everybody, all establlishments, offices, business houses to NOT CLOSE but OPEN on a PRESC RIBED HOLIDAY.
5. on this day every person who is PROTESTING CORRUPTION AND PUNISHMENT TO THE CORRUPT come out with a expression of banner, arm band,, hand bill any thing THEY CAN THINK OF.

6. Let us NOT DISRUPT the country, but ERUPT the SPIRIT OF SILENT PROTEST- in a GANDHI WAy,  GANDHI SPIRIT.

To finalise THIS can we have some voices. to arrange a meeting. where we forget OUR EGOS, and be one amonst all.

You have the right to be silent.

GANDHIGIRI

Re: [HumJanenge] Chalo Assembly- Long March from Nandurbar to Mumbai(500km.)

U R talking about the support, now members do not want to waste their time on this as it is useless.
God knows who are Ssarkara Saints and who r govt. stooges.  Wrong statement that 250 members have supported the proposed statement. S R has recommended to limit words to even 150 words rather 250.  I suggest to recommend '0' word, except address and applicant contact details.  What is your opinion, Roy Sahib.?

I demand to change the name of this grp as Tantrums of S Roy.  It seems that Mr. Wajahat Habibullah rightly call him a great entertainer.

Stop yourselves from giving or reacting to his suggestion to save time otherwise v may become mad.

Re: [HumJanenge] Proposed change in RTI Act

Yes, we all know about this by now. This is contained in the DoPT's comments to some half baked comments which Ms Aruna Roy and her gang of incompetent foreign financed sarkari stooges sent from the NAC.

This is a welcome development. The members of this group have supported this overwhelmingly and over 250 HJ members had sent emails to DoPT supporting the proposal to limit word count to 250 words etc. In fact we had demanded that it be reduced to 150 words after citing the legal basis.

This is your defend

You cannot deny the fact that then and now your language is most inappropriate. Anyway, this forum you should not use to defend yourself or to threat RTI activist and every single citizen using RTI for public cause is an RTI activist, at least citizen with fundamental rights guaranteed by our constitution

You are completely misinformed about the facts of the HumJanenge groups. I can assure you that Mr Shailesh Gandhi was never an owner / moderator of HJ (unlike me). It is also incorrect to say that I was kicked off the group. In fact I am still a member of the HJ-YG group, and it was mutually agreed between me and PMK that I would stop posting to that group using my then public ID (which was then sroy1947@yahoo.c..).

The RTI_India Yahoo group was also begun with the full knowledge and participation of PMK (he was a moderator too), so that many people on HJ who were not from Maharashtra or did not subscribe to the blinkered view of RTI being agitated by persons like Shailesh Gandhi or Shahid Burney etc could evolve their own interpretations of the Act.

About purpose of the group, if you are really intend to discuss only decision of SIC/CIC you should have kept the messaging option in such a way that only after your approval mail posting would have been possible. You are self not adhering to group policy.

Whether it is lady or gentlemen you should not use such language which is not appropriate at all.

This is really sad to see such attitude from you. You must apologize for using such language to the lady. If she and her NGO think 500 KMs is long march there is nothing wrong. Mao itself has never defined the long march distances. For poor Adivasis for their rights, it might be long march.

Mr. Sarabjit,

No need to be Government Spokesperson. Everybody knows the proposed amendment is to make RTI Act weak so people must not be able to seek transparency.

If somebody has fear, can ask people from other state to help

Dear RTI Activists,

In continuation of my request for information, in reply to my RTI application ID no. 10393 dated 30.12.2010, to RCS, GNCTD, I havge received a reply as follows:

"You have requested to provide photocopies of affidavits submitted by 79 members of the Society to the President of the Society who in turn submitted
to RCS before final drw of lots of flats.  The infomation pertains to Society record. The Society is not a public authority, hence your application
cannot be forwarded to society to provide you the information."

MY question is:

1. Is Registrar of Cooperative Societies, Govt. of NCT of De3lhi is not a public Authority? If it is, I have asked for information
which is with this Public Authority?   I have never said that you forward my RTI application to the Society.

2. Is RCS office has no role to play as regards monitoring the activities of the Societies and seek RCS  permission by se3nding relevant documents including
members' affidavits for final darw of lots?

3.  I was the 80th member who was not allotted the flat. No reason is given by the RCS or the President of the Society

4.  If RCS has no role, why 27 Coop. Group housing Socieites of Dwarka which held  the draw themselves as RCS is not ready to send its representative
for the draw, should be given any notice for legal action against them? RCS is not ready to send its nominee for the draw despite Delhi High Court
Orders and instructions of the Cheif Minister of Delhi.

On hearing from RTI activists, I shall give immense material of corrupt practices to the Movement of RTI as well as Fight against Corruption or

Dear Mr. Roy,

If you kick me off..nothing wrong will happen to me. I don't want any self publicity and I never intend to do so either. The language you have used is offensive. About Humjanenge group, you have to also accept that you have created this group for self publicity as original HumJanenge Group was on Yahoo and Started by late Shri Prakash Kardlay and Shri Shailesh Gandhi and many other prominent RTI activisit and citizen were there. If you remember you were "kicked off" from that group.
About other details, my contact no. and everything is part of my mail signature and why should I change it for you?

About purpose of the group, if you are really intend to discuss only decision of SIC/CIC you should have kept the messaging option in such a way that only after your approval mail posting would have been possible. You are self not adhering to group policy.

Whether it is lady or gentlemen you should not use such language which is not appropriate at all.

This is really sad to see such attitude from you. You must apologize for using such language to the lady. If she and her NGO think 500 KMs is long march there is nothing wrong. Mao itself has never defined the long march distances. For poor Adivasis for their rights, it might be long march.

Govind

Dear Govind

I am now a moderator of this group. I am responsible for seeing that rules are adhered to and enforced. When people disregard our rules, I use language appropriate to their offence. The only reason I was not firmer with Ms. Pratiha was because she is a lady.

Incidentally, you are also hereby cautioned that self-publicity is against this group's regulations. Kindly modify your signature while posting to this list.

Warmly
Sarbajit

Dear Pratibha

When you describe your 500 km procession as a "Long March" you insult the memory of a great leader and his brave comrades during their long retreat. It is precisely because of such bakwaas emails (which incidentally has nothing to do with RTI) from NGOs promoting their programs that our members request to leave this group (see email from saikatd).

Hence we have decided to kick you off this group for insulting the memory of a great leader and military strategist.
