You have properly reached the heart of the matter.
We are the defenders of democracy and free speech.
Democracy is not the same thing as mob-o-cracy.

The reason I do not want persons from NGOs on this group are manifold.

Firstly, this is an interface group for citizens and public servants concerning the RTI.
Although we are on different sides of the "RTI divide" we jointly believe that RTI if
used "responsibly" can deliver all information which citizens are entitled to. There is
also a substantial section of "babudom" which wants accountability and transparency, we
believe that RTI Act is one of the ways to ensure this.

Secondly, we are of the view that NGOs are not citizens. As a recent CIC minutes of meeting (07.09.2010) records, the shrill clamor of a few motivated persons cannot be treated as the rational voice of the world when it comes to RTI and associated matters. Mr Shailesh Gandhi has openly disgreed with that view, so it is equally open to him and his NCPRI friends to leave this group. As you say, there are many other RTI yahoogroups - the bulk of which have
no credibility or discipline.

I'm member of 8 RTI yahoogroups for India, many of which I have stopped reading. This group is definitely the best one for many reasons.

[rti_india] SC notice disappears from CIC records

 

A RTI request from a resident of Bengalaru has thrown the Central Information Commission into panic.

On 6 Sep 2010 the applicant demanded a copy of the contempt notice served on Wajahat Habibullah by the Registrar General of Supreme Court as reported in Times of India dated 4.Jan.2010.

"However, on December 4, 2009, the Supreme Court served him a contempt notice for publishing on the CIC website a detailed reasoned order concerning the need for transparency in the elevation of high court judges  to the SC. The SC said the order lowered the dignity of the court."

The office of CIC is proposing to reply to the applicant that "the contempt notice is not part of the CIC records but is personal to Mr Wajahat Habibullah". The legal officer of the CIC has, however, suggested to the PIO to deny that the information (contempt notice) exists..

The applicant is aggrieved because he was issued the first contempt notice by the CIC for allegedly abusing India's new Chief Information Commissioner A.N Tiwari during a video conference.

Provided further that where the Information Commissioner is appointed as the Chief Information Commissioner, his term of office shall not be more than five years in aggregate as the Information Commissioner and the Chief Information Commissioner.

Would you kindly explain where "ANT" has "argued at length as to how to seniority is to be established in the CIC".

Last year when the issue was raised over the relative seniority between commissioners Ansari and Tiwary for the limited purpose of settling the order of recording of names in CIC decisions, "ANT" cited a specific DoPT circular on the subject clarifying that the order of names in the Presidential warrant of appointment determined seniority and not the date of joining the CIC. It may be recalled that Tiwary was sworn in as commissioner later as he was asked to stay on at the persmin by the PM.

Tiwary did not want /covet the post of Chief Commissioner. It is for


protocol reasons that he had perforce to be elevated, since he is
senior to Satyananda Mishra and ranks higher in warrant of precedence
issued by President. other personal comments you have passed on Tiwary
are not realistic. The remarkable fact that both PM and LoO agreed to
Tiwary's appointment speaks about his personal integrity and respect
he enjoys.
