[rti_india] Even Rich Man has no right of information as per Certain Central Information

 

Even Rich  Man (but without proper connection including underworld) has no fundamental right of information as per Certain Central Information Commissioner.

Now, we see   that Certain Information Commissioners had decided (Supreme Court cases) that there is no inconsistency with the Right to information, if information is provided to poor at the 250% times of reasonable cost determined by the Supreme court of India/ Government Of India increased various exemptions and shorten the right to information and made the procedure cumbersome for the remaining 30% citizen to protect the Corrupt officials.

. Information under RTI act can be obtain in various forms (including soft copy and uncertified copies) . Whereas SCI Rules 1966,  Published at web (https://docs.google.com/document/pub?id=1CLOOo8dqqsDQyBKK2PAEJrrh7_LBOcbO_5sN0iIXSHg)   Kindly note, during pendency of case in The Supreme Court of India , only inspection is allowed under SCI Rules 1966. No one(including party to the case)  can obtain copies of document (kindly see Rule 3 of Order XII at Page 35 of SCI Rules 1966). Kindly note, corruption is rampant in India, and there are reported cases Like Ansal Builders –Delhi Uphar Cinema Fire Court case, in which documents were changed / removed in the Courts with the help of Court staff. And certain court staffs are under suspension. By denying information like copies and scan copies, it is protection (and encouragement ) to corrupt court staff, who help in change of documents because in the absence of previous  (old correct) documents copies, it will be difficult to prove that  document are changed/ removed

And after the case is decided ,    only hard certified copy are allowed.   

This exemption is big relief to corrupt officials , Court decisions take decade in the decisions, after word , when apparent error is pointed out to Court like in Bhopal case to the Supreme Court then , it rejected on the limitations point only.

Increase in scope of exemptions . (by wrong CIC order)

As explained above scope of exemption is already increased ,  even party  to the case , are not provided copies from the file. During the pendency of case, normally information is denied to third ,although no exemption under Section 8(1)/9 of the RTI Act, may be applicable.

other benefits (available under RTI Act, 2005 ) are also withdrawn from Citizen by the above wrong decisions will be explained in the next articles.
