An advt. in Hindi was published by the Minister of Micro, Small and Medium Enterprises on 19th Nov. 2011 paying tribute to Mrs. Indira Gandhi, former Prime Minister on her birthday. The advt. stated "Sharandajali, Indira Gandhi……….. ki punya tithi par kritagya rashtra kaa shat-shat naman (19th November 1917 – 31 October 1984". However, English edition of the advt. was perfect. I sent an RTI application to the CPIO of the Ministry which was delivered on 23.11.2011 asking interalia amount incurred on the faulty advt.; action taken or proposed against the erring officials and name of the officer who approved the advt.  After about one month, the application was returned to me stating that the Postal Order is not acceptable since it is not payable to PAO (MSME), New Delhi.  (Pay to Column was left blank). I sent the duly filled IPO and application again on the next day which was delivered on 27.12.11.
 
          Today on 30.1.2012, I received letter dated 06.01.2012 by ordinary post from Shri Harish Anand, Director (Publicity) stating that the information is being gathered and it will be provided to me as soon as it us gathered.  Even the available information with the Accounts Deptt. of the office has not been sent in utter disregard of the time limit for the 30-day. I have not been informed about the transfer of my application u.s. 6(3) of the RTI Act to the concerned PIO.  I understand that all the information may be available at the Head Office, New Delhi since the advt was circulated by DAVP.

NEW DELHI: With an addition of nearly 2,500 complaints every month, the Central Information Commission (CIC), which has an astounding 26,049 pending cases is well on its way to becoming redundant. The reason: the CIC disposed off 22,414 cases last year, which means that there is a pendency of 14 months for every appeal and complaint making the information received by the applicant outdated and often useless.

Commission chief Satyananda Mishra expressed concern saying, "If the pendency continues increasing, the waiting period will also increase. We are very concerned and will have to think of radical ways to tackle the problem. One of the issues that we will discuss is `summary disposal' of cases through just speaking orders to save time."

The CIC has six information commissioners, including its chief, though it has a sanctioned strength of 10. One of the first tasks undertaken by Mishra on taking over was to write to the government asking for more commissioners keeping in view the large number of cases coming to the CIC. However, there has been little progress in ramping up the strength so far.

RTI activists are concerned and have been vocal in their disapproval of the long waiting time. One prominent RTI activist, who did not wish to be named, said, "The hearing for a case where I had sought information took place three months ago and in fact only the formal order had to be issued since I was given the impression that the decision had been taken. However, I have still not heard from the office of the information commissioner.

Prof Rajeev Kumar, formerly with IIT-Kharagpur, said that he had sought information on IIT-Madras in 2010 and only managed to get hearing in September, 2011. "I received the order after three months in December, 2011 and even then the institute gave me only part of the information. It was of no use. Despite the long delay the no penalty was charged. CIC has become infructuous," Kumar said.

Sources said that some cases as old as 2006 were still pending before the Commission with no action being taken.

The States are not filling in even a fraction of the sanctioned posts There's lack of transparency in selection.Criteria hasn't been formulated.Total ad-hocism has prevailed all these years.
Standard templates and other standardised systems haven't been developed(as done in top corporate world).
Techno-management principles are rarely,if at all,used in managing the show at all levels.
Most importantly,sou-motto disclosure of information,in standardised formats is simply missing, in spite of a lapse of 6 long years. 
The RTI community MUST now go the whole hog as a national campaign to redress the situation.
I'm prepared to take lead.
Lets see who all are there to join and contribute in meaningful manner !

I am prepared to donate Rs.5000/- from my pocket and another Rs.5000/- I can get from many beneficiaries who have got substantial amount [few in lakhs] but for RTI. Some one in or near Delhi has to take initiative with cooperation of public spirited advocates.

Govtss do not understand any language other than that of HC or SC. Let us talk to it in that language.

NEW DELHI: With an addition of nearly 2,500 complaints every month, the Central Information Commission (CIC), which has an astounding 26,049 pending cases is well on its way to becoming redundant. The reason: the CIC disposed off 22,414 cases last year, which means that there is a pendency of 14 months for every appeal and complaint making the information received by the applicant outdated and often useless.

Commission chief Satyananda Mishra expressed concern saying, "If the pendency continues increasing, the waiting period will also increase. We are very concerned and will have to think of radical ways to tackle the problem. One of the issues that we will discuss is `summary disposal' of cases through just speaking orders to save time."

The CIC has six information commissioners, including its chief, though it has a sanctioned strength of 10. One of the first tasks undertaken by Mishra on taking over was to write to the government asking for more commissioners keeping in view the large number of cases coming to the CIC. However, there has been little progress in ramping up the strength so far.

RTI activists are concerned and have been vocal in their disapproval of the long waiting time. One prominent RTI activist, who did not wish to be named, said, "The hearing for a case where I had sought information took place three months ago and in fact only the formal order had to be issued since I was given the impression that the decision had been taken. However, I have still not heard from the office of the information commissioner.

Prof Rajeev Kumar, formerly with IIT-Kharagpur, said that he had sought information on IIT-Madras in 2010 and only managed to get hearing in September, 2011. "I received the order after three months in December, 2011 and even then the institute gave me only part of the information. It was of no use. Despite the long delay the no penalty was charged. CIC has become infructuous," Kumar said.

Sources said that some cases as old as 2006 were still pending before the Commission with no action being taken.

Health dept takes a year to prepare autopsy report

KOLKATA, 28 JAN: Doctors in the state took over a year to prepare, and give relatives, the autopsy report of a young man who died in a road accident in October 2009.
His father, who is now in his 60s, ran from pillar to post looking for the report. Without it, his son's family who live in Mograhat village in South 24-Parganas, had been unable to apply for payment of his life insurance.

The father was finally handed the report in November 2010 after he filed a Right to Information Act (RTI) appeal.

In addition, in June 2011, the state information commission told the state health department to give Rs 10,000 in compensation to the next of kin.

The commission also held an inquiry, during which they found some bizarre irregularities. The hearing report reads, "The Commission is distressed to note that whereas the post mortem was conducted on 7 October 2009, the report was written by the concerned doctor only on 18 October 2010, after the lapse of one year."

For some reason, the report was also backdated. It was signed with the date as 7 October 2009. The Commission stated that it will "bring the case to the attention of the health and family welfare department for taking appropriate action."

The youth, whose name has been withheld by the family, died in a road accident in Mograhat in South 24-Parganas on 7 October 2009. The post-mortem was done the same day at Calcutta Medical College and Hospital. The washed body was then handed to the next of kin for cremation. But, even after repeated requests, health officials failed to hand over the autopsy report for over a year.

The boy's father, Mr Shaukat Gazi, wrote to the state public information officer and the chief medical officer of health to try to get the certified post-mortem report under the Right to Information Act (RTI). That was on 16 July 2010. But he didn't get any response.

Two months later, Mr Gazi appealed to the special secretary of the health and family welfare department, the RTI appellate authority for the department. The appellate authority then asked the local chief medical officer of health and the medical superintendent of Diamond Harbour Sub-divisional Hospital to give the report to Mr Gazi.

Another month passed and Mr Gazi was told by the superintendent to go and get the report from the Mograhat Police Station in South 24-Parganas. So he went to the police station, and was finally given the report there in November 2010.

Angry that it had taken so long for him to get the report and claiming that he was harrassed, Mr Gazi filed a second appeal on 14 February 2011, asking for the health officials to be punished as they had violated the RTI Act by not handing over the autopsy report. The state information commission heard the matter on 28 June 2011, subsequently ordering that the department pay compensation to the next of kin.

KIC has virtually made the section 18 as defunt and quashed it and changed the basics of RTI Act. It is not correct and KIC has no such power. Even the recent Supreme Court has not given such sweeping jugement rendering section 18 worthless and has only said that information cannot be asked by invoking this section and this section should be used to penalize PIOs, not for giving infn.

In my opinion, applicants are free to use section 18 or 19 simultenously in the light of the SC decision, first appeal for getting information and complaint for non-receipt of reply of RTI application and other provisions of section 18.   Pl. note that FAA has no power to penalize the PIO, therefore complaint to Infn. Commission.

The States are not filling in even a fraction of the sanctioned posts There's lack of transparency in selection.Criteria hasn't been formulated.Total ad-hocism has prevailed all these years.
Standard templates and other standardised systems haven't been developed(as done in top corporate world).
Techno-management principles are rarely,if at all,used in managing the show at all levels.
Most importantly,sou-motto disclosure of information,in standardised formats is simply missing, in spite of a lapse of 6 long years. 
The RTI community MUST now go the whole hog as a national campaign to redress the situation.
I'm prepared to take lead.
Lets see who all are there to join and contribute in meaningful manner !
