Dear Friends
Certain Central Information Commissioner, had decided that the Right to Information Act is not applicable for the information available in the other rules.
The error in judgment of CIC is explained by simple puzzle played by the children to trace the error in the following case.
If one person has ten coins of ten paisa, then total amount is
10 paisa X 10= 100 paisa or Rs1/=.
Whereas CIC way of calculation will result as follows.
10 pasia = rs.1/10,
Then total amount is
= rs.1/10 x rs.1/10= rs 1/100.
And the result is
100 paisa = Rs1/100..
Kindly note the error in above calculation for ten coins (a pure number) ; it is used 10 Paisa/ Rs. 1/10 (number with adjective was used) and used of adjective is wrong.
Whereas actual results in above calculation is as follows.
100 paisa square = 1/100 Rs. square.
Above kind of tricks are played by fraudulent person for small amount to prove any thing.
Similarly, in the CIC decision, CIC had asked deliberately wrong question and given the wrong answer as stated above.
Question asked by the CIC.
Whether the information sought is to be provided under the Supreme
Court Rules 1966, or whether these stand overridden in light of Sec 22 of
the RTI Act, 2005.
Whereas correct question should be
Whether for request for information Under the RTI act, the Supreme Court Rules 1966 ( Read as Public Authority Rules/ Law) can override the RTI act, 2005 and increase the exemption for denial of information. (If the answer is yes, then it is against Delhi High Court decision in Bhagat Singh Vs CIC)
Whether benefits available TO Citizen for request for information Under the RTI act can be denied that similar provision is absent under the Supreme Court Rules 1966 ( Read as Public Authority Rules/ Law)and P/a Rules Law can override the RTI act, 2005 (If the answer is yes, then it is against Delhi High Court decision in Bhagat Singh Vs CIC
