I suggest that you watch this video from 9:00 mins onwards and see how "Nirbhaya"s male friend shows how she was dying  while Delhi Police had jurisidictional fights as 3 PCR vans fought over which thana the case came under. and No ambulance reached the spot.

Here is another video I took myself of a Delhi Police Sub-Inspector lying bleeding and shot (by his own hand) right outside my home in a post area of Delhi. Incidentally I was the only person who called the Police 100 and described everything, but they reached after 1 hour, Once again no ambulance. Instead of taking their comrade to the nearest hospital only 3 minutes away, they (under instructions)  took him 75 minutes away to AIIMS in dense traffic where he was declared Dead on Arrival. His girirfriend also died 3 hours after reaching AiiMS.

So we residents of this jungle called "National Capital" really don't need foolish / stupid comments from civilised places like Tamil Nadu about how efficient Delhi Police is.

The other day one Apex court judge was saying that merely because somebody (read party) won 51% majority it does not mean that the opposition had to keep quiet for the next 5 years. Hence he was supporting street protests in the name of freedom of expression. The learned judge seemed to forget that a law passed by the parliament can be challenged only in the Courts and that there are Constitutional provisions to defeat an elected government through a vote of No Confidence and by amending a law by a due process of voting.
Blaming police is a simplistic myopic approach. Pl do not throw the baby with the bathwater.

Since I, probably unlike you, interact very regularly with top and bottom level officers in Delhi Police, I can say the following with complete confidence in its truth and veracity

1) Delhi Police is now a force for repression, police brutality and used mainly as an instrument of state enforcement. Although it must be said n their defence that most of the brutality videos on Twitter were actually by Central Police Forces taking out their revenge against Muslims for incidents like Phulwama

2) If a Delhi Police SHO has a choice between
   a) registering an FIR for incitement for communal violence, or
   b) locating a missing pet poodle of his CP's wife, he will do the latter everytime

"Meanwhile, Delhi Police has also become sensitive about the issues related to dogs. Now pet owners are easily getting the registrations of missing complaints done at the concerned police stations.

Dependra Pathak, joint commissioner of police and the spokesperson of Delhi Police said: 'Whenever there will be a complaint, FIR will be registered. Be it for a human or an animal. Cops have also been instructed to take action."

3) In the so-called Nirbhaya gang rape case of Dec 2012, the police registered the FIR (backdated) after 48 hours, and only after 3 magistrates somehow extracted in-seriatim the "proper" dying declaration which whitewashed their political master's role in it. (PS: The convicts seem likely to be hanged tomorrow)

4) The primary "business" of  Delhi Police is collection of bribes which are funneled upwards in the chain where everybody has to meet set targets and receives their "points" of it.

5) The ordinary Delhi Policeman on the streets is completely scared nowadays, and is old and unfit with string of medical conditions, is not prepared to work any more and is only cutting time till retirement. All the younger medically fit ones have got themselves assigned as PSO to some neta or VIP duty. Nobody is doing cutting edge investigation anymore and most crimes are solved on basis of informants or motivated complaints. The "Singham" / "Ab tak Chappan" types are anyway all nowadays paid shooters for the 50 odd top criminal gangs which BJP has set up territorywise in Delhi under their councillors. There is no difference now between Bombay mafia and Delhi mafia, and criminals are often better armed than the cops.

6) Delhi Police was completely demoralised after the fight with lawyers when they saw the high-level coverup by the judiciary to protect lawyers, and police realised that they have to depend on these same lawyers to represent them in the courts.

7) All the active operational deployment of DP is for "VIP" duty and VIP routes. Even the cranes for clearing traffic on roads are diverted to VIP route creating compete chaos for all road users

8) Like in 1984, this time also the Delhi Police did not move till they got green light from high level. They all saw what happened to Sanjeev Bhatt after Gujarat 2002.

9) If anybody is to be garlanded for this monumental cockup it is A) AJIT DOVAL NSA and B) ANIL BAIJAL LG of Delhi. No reasonable person would believe they were not part of it and could not control it if they wanted to.

However, it should be noted that Islamic terrorists make clever plans with high level of secrecy and believe in surprise attacks and guerilla tactics.  Even advanced country like USA could not prevent the September,11 attack on twin towers.  Equally, several European countries including Russia which have strong intelligence agencies could not anticipate several violent attacks by terrorists in public  places.

While it may be partly true that there have been intelligence failure by Delhi police, it should be recognized that such inadequate intelligence is not uncommon even in developed countries with sophisticated scientific systems, particularly with regard to intelligence on terrorist acts.

However, one gets an impression that Delhi police could have been generally aware of some disturbance to come and perhaps, this is why police force was in strength in trouble spots during the two days of riots.

In all probability , the police force might have been under instructions to handle the situation carefully and tactfully and as softly as possible , during the two days of President Trump's visit.  Probably , police thought that the riots would not be as severe as it was . On the other hand, if the police had taken strong action   against the arsonists  who are motivated and determined extremists, it would have resulted in shootings . In such case, the same media and critics would have blamed the police in severe terms for brutalities and "mass murder". U N Human Rights Council would have "eloquently" commented about the situation and condemned Delhi police.

Apart from sensation seeking Indian media , there are also section of Western media like BBC,  New York Times and some lobbyists in Western countries who seem to be  all the time looking for negative developments in India, probably  to show case that India as restless country with deep communal differences. Such media , while not highlighting the extremely warm and huge reception accorded to President Trump,  only highlighted the violent riots that took place during Trump's visit.

All said and done, the violence ended when President Trump left India and the objectives of Islamic terrorists to paint Indian  Prime Minister in bad light partly succeeded.

My appeal is that  let not doubts be created about the commitment and competence of Delhi police without analysis of the situation.

India is a target place for Islamic terrorists today and they will leave no stone unturned to cause problems for India in variety of ways. The fact is that world is not helping India in fighting against terrorism ,  which include  UNO and all of them are watching from galleries.

In such circumstances, the fight against terrorism in India has  to be essentially faced and won only by India, confronting  the terrorists operating from abroad as well as in India.

The loyalty of every Judge in our country has to be only to the very sacred Constitution of India. The recent eulogizing of Prime Minister Narendra Modi by Supreme Court Judge Arun Mishra was totally uncalled for an in utter bad taste. Justice Mishra who is due to retire on 2nd September went well overboard. . We all saw how then Chief Justice of India P. Sathasivam who within weeks of his retirement was rewarded by Narendra Modi with an appointment on 31st August 2014 as the Governor of Kerala.   

As a desperate BJP wants to overpower the Judiciary too, there is a very disturbing disquiet over the slippery slope on which judicial values are slithering. With Narendra Modi all out to corrode and corrupt even the Independence of the Judiciary, to ensure the highest standards of judicial independence and to ward off even the faintest trace of governmental influence on the judiciary, there needs to be at least a two year "cooling off period" for retiring judges before they accept any post retirement posting.

As judicial independence of Judges rests entirely on maintaining an incorruptible detachment from the government of the day, it cannot be allowed to be morally compromised by lobbying for cushy post-retirement sinecure postings. We have witnessed instances where Judges have fixed their retirement nests much prior to even demitting office.

In times when the Indian Judiciary is passing through a very turbulent phase, this "jobs-for-the-judges" syndrome could place judges potentially open to governmental influence leaving scope for "pre-retirement judgments" being predisposed by the craving of a "post-retirement job".

A former Chief Justice of India Justice R M Lodha led by example that judges should not take any constitutional or other position at least two years after demitting office. The Constitution of India is very clear on the distinct roles of the Executive, Legislature and Judiciary. It envisages a free, fair and independent Judiciary. The highest standards of judicial independence must be ensured by warding off even the faintest trace of governmental influence on the judiciary.

The demand to keep Supreme Court and High Court Judges away from immediately taking such post retirement benefits becomes the need of the hour and will thus ensure that those about to retire do not run behind those in the establishment thus giving a death knell to the independence of the judiciary. There is a need of concerted efforts towards propping up highest standards of judicial accountability.

The Judiciary should never be manned by persons who are tilted or aligned to any political party. Judges should have the spine to crack on illegalities done by all politicians, regardless of how high positions they hold. It has to be ensured that judicial accountability is maintained at all times with every Judge conforming to the highest standards of uprightness and integrity. If Judges cannot independently balance the scales of Justice, the Temples of Justice become pointless ending up as dens of chicanery and jugglery.

Subject: [IAC#RG] WILL SUPREME COURT JUSTICE ARUN MISHRA BE ANOTHER P. SATHASIVAM?

The loyalty of every Judge in our country has to be only to the very sacred Constitution of India. The recent eulogizing of Prime Minister Narendra Modi by Supreme Court Judge Arun Mishra was totally uncalled for an in utter bad taste. Justice Mishra who is due to retire on 2nd September went well overboard. . We all saw how then Chief Justice of India P. Sathasivam who within weeks of his retirement was rewarded by Narendra Modi with an appointment on 31st August 2014 as the Governor of Kerala.   

As a desperate BJP wants to overpower the Judiciary too, there is a very disturbing disquiet over the slippery slope on which judicial values are slithering. With Narendra Modi all out to corrode and corrupt even the Independence of the Judiciary, to ensure the highest standards of judicial independence and to ward off even the faintest trace of governmental influence on the judiciary, there needs to be at least a two year "cooling off period" for retiring judges before they accept any post retirement posting.

As judicial independence of Judges rests entirely on maintaining an incorruptible detachment from the government of the day, it cannot be allowed to be morally compromised by lobbying for cushy post-retirement sinecure postings. We have witnessed instances where Judges have fixed their retirement nests much prior to even demitting office.

In times when the Indian Judiciary is passing through a very turbulent phase, this "jobs-for-the-judges" syndrome could place judges potentially open to governmental influence leaving scope for "pre-retirement judgments" being predisposed by the craving of a "post-retirement job".

A former Chief Justice of India Justice R M Lodha led by example that judges should not take any constitutional or other position at least two years after demitting office. The Constitution of India is very clear on the distinct roles of the Executive, Legislature and Judiciary. It envisages a free, fair and independent Judiciary. The highest standards of judicial independence must be ensured by warding off even the faintest trace of governmental influence on the judiciary.

The demand to keep Supreme Court and High Court Judges away from immediately taking such post retirement benefits becomes the need of the hour and will thus ensure that those about to retire do not run behind those in the establishment thus giving a death knell to the independence of the judiciary. There is a need of concerted efforts towards propping up highest standards of judicial accountability.

The Judiciary should never be manned by persons who are tilted or aligned to any political party. Judges should have the spine to crack on illegalities done by all politicians, regardless of how high positions they hold. It has to be ensured that judicial accountability is maintained at all times with every Judge conforming to the highest standards of uprightness and integrity. If Judges cannot independently balance the scales of Justice, the Temples of Justice become pointless ending up as dens of chicanery and jugglery.

I am thankful for your bringing Justice Kamleshwar Nath's email to my notice (see my ps below) and your comments to it.

As an eminent Secretary rank officer (and technocrat) yourself, you are doubtless well aware that Art. 11 "apparently" gives an unfettered right to Parliament to regulate citizenship, over-riding the preceding articles which specifically discourage those Indians who had voluntarily acquired citizenship of another country from acquiring (re-acquiring) Indian citizenship.

After reading your comments, there is some ambiguity in my mind concerning your references to majority and non-majority/minority communities. Since ours is a pan-India internet forum, certainly you could not have been referring to Hindus or Muslims respectively in this context since Muslims are a majority in Jammu and Kashmir, Sikhs are the majority a little lower down in Punjab (East), and Christians are the majority in most states of North-East (Nagaland, Mizoram, Manipur, Meghalaya...) and so on in this great diversity which we celebrate as "India, ie. Bharat".

FYI I would like to share a theory that
It is Hindus who are the minority throughout India and discriminated against everywhere

Hindus and Muslims (ie. Hindustanis) are both discriminated against at every stage in this country, and the present rotten system is geared towards rigging the setup against both Hindus and Muslims, in favour of non-Hindus.The CAA amendment is just another step in that direction, which is why it is being opposed publicly by Muslims and privately by Hindus since both communities are "aware of the implications". The Hindu Samaj is firmly opposed to any dilution of, our already weak, citizenship law(s) which this CAA has brought about. Hindu Samaj categorically opposes CAA albeit for very different reasons from those being agitated by Muslim protestors. Hindu Samaj supports the National Citizenship Register (with proper safeguards for Hindustanis).

I therefore hope that our learned forum experts like yourself will speak freely since there is no barrier for communicating facts/thoughts frankly.

PS: Justice Kamleshwar Nath's message (now appended below in the trailing emails) was not circulated via our forum, and appears to be a private communication to Shri N.S. Venkatraman and a few others (using "reply all").            Broadly agreeing with your views, I think that the CAA matter should be seen in the light of the following factors:

  1. The CAA is constitutionally valid. The guarantee of right to equality under Article 14 of the Constitution should be read with Article 15 which prohibits discrimination amongst citizens on the grounds of religion. The upshot is that discrimination amongst non-citizens is not prohibited. This distinction is reasonable and understandable, otherwise aliens would get all the rights of citizens. The matter is before Supreme Court and any reasonable person would have waited for the result. The agitation is an attempt to derail the due process of law.
  2. No person or body has taken the responsibility of starting the agitation against CAA.
  3. The effect of CAA will come to be known when it is implemented; the agitation is calculated to prevent its implementation ab initio.
  4. The only beneficiaries of the agitation, openly pronounced, are those Muslims who are foreigners.
  5. Non-Muslims who have joined the agitation are persons interested in overthrow of BJP Government so that they get an opportunity to capture power.
  6. Illegal Immigrants are obviously a threat to India's Security and Sovereignty; no Country wants illegal immigrants.
  7. Knowingly or unknowingly, the agitation has the effect of promoting Pan-Islamic Ideology. India's experience with Partition has been very sad. Before Partition, India was Secular. After Partition, while India continued to be Secular, the parted portions of India became Constitutionally Islamic. "Islamic Republic",  which Pakistan claims to be is a contradiction in terms. There cannot be a 'Republic' which is Islamic; it is essentially a Communal State. What this change means, is clearly before our eyes: Religious denominations, other than Islamic, are decimated. Hindu population in Pakistan/Bangladesh is reduced to non-entity from a sizeable one at the time of partition. The forced exodus of Kashmiri Pandits from Kashmir Valley in 1989-90, which the then governments slept over, is a living proof of brutality in an effort to destroy Hindu identity in that area. Can there be any wrong if such displaced Hindus are given citizenship of India as of right?

Thankfully, Sri Ranga Rao has recognised the need to identify illegal immigrants in Assam; why should it not extend to whole of India? When will the 'right time' come in his noble opinion? Has the waiting for 75 years not been sufficient?   It is the current Government which has picked courage to solve the problem and preserve India's Security and Sovereignty.

A dispassionate consideration of these factors will establish that, as a plain Human Right, the displaced non-Muslims should be absorbed in India and illegal Muslim immigrants must not be given citizenship as of right. Of course, in individual Muslim cases citizenship may be granted for proper reasons; CAA does not stand in their way.

In the matter of public provocation by politicians, both Muslims and non-Muslims individuals/groups blurt out; and both must be answerable to Law. The Law will take its course, sooner than later.

     The CAA, NPR & NRC are appropriate and necessary.

It is for Arvind Kejriwal to explain how motivated agitators like Kapil Mishra (who comes from an RSS family as does Kejriwal, Sisodia etc.) was a cabinet minister in his AAP government.

 

What we at IAC really ought to be looking at is why INDIA is sucking up to USA and awarding big-ticket deals to them at highly inflated prices. Are we to be the next "designed in USA" failed fundamentalist US client-state-nation like Pakistan and Iran who all had US backed dictators to purchase the output of US arms manufacturers ?

 

I remind you, that we PROUD HINDUS (not ashamed to say who we are) are still to see any 50% countervailing export from Anil Ambani group ( which has just declared BANKRUPTCY) in overpriced RAFALE deal. As HINDUS we are concerned that MODI (bania OBC) and AMIT SHAH (Jain posing as Hindu) 2nd. EAST INDIA COMPANY  have converted HINDUSTAN into dumping ground of consumers for US MNCs like AMAZON, WALMART, FACEBOOK, GOOGLE, if this is not overseas 2nd EAST INDIA COMPANY Government then we don't know what is.

For the last several days, some members of the Islamic group have been agitating against CAA. Now they are blocking roads in Delhi, Chennai and other places, though the government has assured that CAA would not affect any citizen of India and judiciary have banned such road blocking protests .

But, the agitators are determined  to continue with road blockade. Obviously, they want to create a law and order situation, so that the government will forcibly remove them which will lead to stone throwing, violence, lathi charge and may even be firing. 

Probably, the agitators want to create a situation where  India will look like a disturbed country and draw the attention of the world and discredit the government. Of course, some Islamic countries and some opposition parties in India will call the government action as suppression of freedom and minority oppression.

Can anyone tell me how the government of India should deal with this situation.? So far, government of India has been extremely patient and silently watching. How long can this continue ?
