[rti_india] Need Help on RTI : Case closed without giving information

 

Dear Sir,

I need a help in my RTI case, which has been closed without giving any information. Here goes some background of the application.

I was trying to get the service record of a retired (possibly compulsorily) judge. Please find the attached Application for the same. and the response of the information commission on attached Response.

  1. I had applied for information to High court on 17th May 2010.
  2. By mistake, I had mentioned the date as 17th June 2010. But I submitted on 18th May itself. You can check this in the acknowledgment seal on the application.
  3. I waited for nearly 40 days, and appealed to the information commission on 28th June 2011.
  4. I went to the information commission to check the status of my case 3 times, but I was told, I will be intimated once the hearing is scheduled.
  5. When I went recently, I was shocked to know that the case has been closed. When I inquired, they said, they sent a summons to me on 2nd APRIL asking me to appear on 11th APRIL, by an ordinary post.
  6. I have never received any post / mail / phone from them till date, though I had furnished all the communication details to them.
  7. More astonishingly, the case has been closed saying that I have applied without waiting for the stipulated 40 days. They have misused my mistake of mentioning the date wrongly [number 2 above] to a greater advantage.
  8. The clerk of high court, has never given me any information even after the 11 months after my application, and this point has never been asked/discussed in the hearing, inquiry at the information commission.
  9. I asked the Information commission officials to open the case again, they said, if I open, the respondent [high court clerk in this case] will say that this refers to a old case which already has been closed, and they are asking me to apply for new application to high court, wait for 40 days and apply again.
  10. Now I am back to my original position, applying for information, and have to wait for 40 days and appeal against the information commission, and go through this waiting for hearing for an year or so, and get nothing :(
Dear sirs, could you please guide me, as how do I proceed to get the information with this thick-skinned bureaucrats.
