[rti_india] regarding Salsa Pinto Vs State of Goa

 

Dear Jayaprasash dabral ji,
 
Whether the copy of the Salsa Pinto decision has been sent to youm if so, I m sure that you will find the answer to your query in that decision itself.
 
There is no blanket ban on question of what etc. This applies only to asking about some policy like why this policy was framed but you have asked about the violoation of the policy and the decision is not applicable to you.  There is enough material in section 4, suo motu, to justify the demand for information.
 
I am mailing you separately copy of my first appeal wherein the CPIO has taken such stand citing one other case decided by the CIC but finally, he has to give the infn. after I filed the first appeal.

Dear Friends, 
I have received a reply for PIO, Forest Department, Uttarakhand  who have denied the information to me because I had asked : 
Kindly provide me information of the names and designation of the officials involved in the felling and transportation of the 13 sleepers of deodar wood and why the officials had given verbal instructions to let the truck pass without the transit permit and required forms. 
In reply the PIO has said that he has received order from Uttarakhand Govt. that as per 'Salsa Pinto Vs. Information Commissioner Goa he is not required to reply to any question which has the word 'why, what and how' in it. 
Kindly let me know what I can do in this regard because of this citations the information is likely to be denied to me.  If there is any other citation which can counter this citation then kindly send me a copy of the same.
