In a house of 70, the BJP has 31 and its alliance partner the Akalis
have 1. That makes it 32 - less than 36 required for majority.
The AAP has 28, the Congress with 8 has offered unconditional outside
support. That makes 36.

The "unconditional" outside support offered by the Congress means the
Congress will not take part in decision making. While it'll be free to
criticise the AAP government inside and outside the assembly it'll not
vote to bring down the government.

Under this offer the AAP can do whatever it could do had it won an
absolute majority on its own.
That's quite a fair offer.
If the Congress reneges on its commitment it'll be discredited in the
eyes of the people.

The AAP is of course aware of the pitfall - the possible public
reaction, of refusing to form a government under the given
circumstances, so the drama in hunt for a credible alibi instead of a
straightforward refusal.
But the people who voted for the AAP on the basis of its commitment to
cut electricity rates, supply free water and, more particularly, the
promise to regularise the shanty clusters - jhuggi-jhopri, cannot but
be mighty disappointed.

The AAP has asked the Congress and the BJP to agree to a set of points
many of which fall well beyond the purview of the Delhi Assembly.
So it's just a ruse and not a very compelling one.
That's why Kejriwal has not turned down the offer to form a government
right away, contrary to initial indications.
He has to convince his own following.
