Re: [IAC#RG] Faction war in AAP

Dear Venkataraman,
1. The existing system in India precludes honest, patriotic & intellectual citizens from entering the corridors of power -- nay, it even deprives them from trying their Luck (it is literary a toss of the coin) in Courts. The Guarantee contained in Article 32 of the Constitution is available only when you have and can shell out more than Rs.712 on Court Fees -- even if you do not wish to hire any Advocate, viz. Rs.500 for Civil Writ Petition, Rs.100 for the Application to Appear in-Person (i.e. without Advocate), Rs.100 for Interim Relief and Rs.12 for just one Annexure; in addition, you will pay Rs.15 per page as Typing Fees [ a Writ Petition mandatorily contains one Cover-Page, one Index & one Affidavit and, at least, 1 page of Synopsis and List of Dates & Events, 4 pages of Petition (one page for Cause-Title and Mandatory Declarations in Paragraph 1, 2 pages for Questions of Law and Grounds, 1 page for Facts & Annexures, and 1 page for Prayers -- you
cannot reduce the number of pages further) etc], pay for the preparation of 3 sets of Paper-Books containing photocopies of the above (photocopying costs Rs.1 per page, and preparation of Paper-Book costs Rs.10 per such Book) and the 'dori' (cost Rs.2) to bind the above. And, at least, 1 set for yourself.

Moreso, you will have to go all the way to New Delhi, stay in a hotel -- an ordinary one costs Rs.500 per diem (check-out time 12 O'Clock Noon), then travel to Supreme Court (be prepared to be frisked by the Security at the Main Gate itself) to find an Advocate or Advocate's Clerk who is willing to 'identify' you on your Affidavit (albeit for a Fees) then get the Affidavit signed by an Oath Commissioner (his Fees is Rs.20, whereas a Notary Public may charge anything between Rs.50-100), obtain 1 set of Listing Proforma and 2 sets of Filing Index (these cost Re. 1-2 each), and annex your Identity Proof (showing your photo and address) to the Petition. And then only you can file the same at the Filing-Counter.
Stay put in Delhi until Office Objections/Defects have been raised on your Petition by the Registry of Supreme Court -- once Defects are pointed out, cure the same (all this may take a minimum of 4-7 days).

Continue staying in Delhi because your Petition would first be listed, in about 7-10 days, before the Registrar who will interview you to ascertain whether you are able to assist the Court -- if he/she is satisfied by your oral performance, he/she will send an Office Report to the Court (i.e. Division Bench comprising of 2-3 Hon'ble Judges).

Keep waiting in Delhi for another 5-7 days for your matter to be listed -- hardly time enough for you to go back all the way to your Home in Kanyakumari and then back to Delhi in just one week! Thus, the Bill for your Lodging alone would run into thousands of Rupees -- for that Amount you could have hired a mediocre Advocate who would have drafted your Petition, paid one or the other Advocate-on-Record Rs.500 to sign the said Petition, and then argued it himself/herself. Caution: about 95% of Fresh Matters are dismissed on the very first hearing -- hence, the 'toss' (supra) if you fail to hire a good Advocate-on-Record alongwith a very good Senior Counsel; an Advocate-on-Record's Fees is around Rs.35000 for the case, and a good Senior costs about the same Amount but on a daily basis.

On the Date of Hearing, go early because you will need to obtain a photo-identity Pass from the Pass-Section to be able to enter the inner perimeter of the Supreme Court. And if you are late in reaching the Court-room and, thus, are not present when your Case is called-out, then your case is liable to be 'dismissed for non-prosecution'. Now, if the Bench permits you to appear in-Person, you can present your case -- else, accept whatever kind of Advocate is assigned to you under the Orders of the Court by the concerned Authorities.

2. The Security Amount for contesting a Lok Sabha or State Assembly Election is prohibitively high for a really 'honest' man to afford -- no Bank is willing to issue even a Loan for this purpose.

I  fully agree
with the above remarks of NSV. It will be a sad day if AAP
turns out to be yet another Indian political party cast in
the same mould.  In that case the party will go down in
history as one which  betrayed the faith placed in it by
the Indian  people. One can only hope that the party
leadership realizes this and makes all out efforts to live
up to their  promise of being different, in every action
Let leaders  of AAP know  that the whole world
is watching them. Will they raise up  to the occasion?

FACTION   WAR   IN
  AAP

At least
some people thought that AAP will set new standards
and emerge as role model for other political parties in the
country. In any
case, this is what Kejriwal & his friends claimed and
based on such claims they  campaigned during the Delhi
poll.

The present
faction war in AAP clearly indicates that this
party is really no different from other political parties in
the country,
with  ego , prejudice and one upmanship  becoming
the central factor in the relationship between the persons
in the
leadership position of the party.

Even though
Delhi voters responded to the campaign of AAP
and provided unmatched support for the party in the recent
Delhi election, it
has not brought any sense of responsibility amongst the
party leaders but only
created friction amongst  them, obviously
due to the greed  of dominating the party
leadership, to reap the benefits of
power.

Delhi voters
ignored several complaints and allegations
against the leadership of AAP such as collection of tainted
money from all and
sundry for the election campaign and providing fictitious
account for the money
collected.  So far, AAP has conveniently
ignored such allegations. It would have been appropriate for
the party to order
an enquiry about the allegations against AAP after coming to
power, if the
party were really true to it's claim of  having tall
standards of probity and
accountability.

The present
squabble in AAP only provides more frustration
and disappointment to Indians who long for emergence of
patriotic, capable and unblemished people in
