otherwise also the restriction is violative of article 14 of the Constitution. Supreme Court constitution Bench in Anwar Ali Sarkar Vs West Bengal has clearly emphasized on reasonable classification.
"The guiding principle of this guaranty is that all persons similarly circumstanced shall be treated alike both in privileges conferred and liabilities imposed. It has been said that 'the equal protection of the laws is a pledge of the protection of equal laws'". 
Class legislation is that which makes an improper discrimination by conferring particular privileges upon a class of persons, arbitrarily selected from a large number of persons, all of whom stand the same relation to the privilege granted and between whom and the persons not so favoured no reasonable distinction or substantial difference can be found justifying the inclusion of one and the exclusion of the other from such privilege".
Here in this issue Private vehicles with petrol and diesel are not singly responsible for pollution. Taxis, motor bikes , trucks , tractors and many other vehicles are equally responsible. 1) How govt can exempt single lady driven vehicles from restriction ? 2) How taxis with diesel fuel can be exempt ? in fact by restricting pvt vehicles people may depend upon pvt taxis and they will play more trip than usual .
So , on the basis of this important issue any affected party , those who have got challan  can approach the court and claim the refund.. either by filing civil suit or by filing writ petition.  From the recent High court order it seems that no body has took the issue of unconstitutionality..
