SUBJECT :FIR REGISTERED ON A RTI ACTIVIST MR. TARUN AGRAWAL BY DEO AJMER.
Dear Sir,
With due respect, it is humbly submitted that the RTI Community is extremely perturbed over the registration of Complaint against the RTI Activist Mr. Mr. Tarun Agrawal for the alleged misbehavior merely for the fact that Mr. Tarun Aggawal was instrumental in filing a Consumer case against the DEO, Ajmer and getting a penal compensation for violating the law by the Public Information Officer of that office. This is a retaliatory action of the DEO office Ajmer and the action is arbitrary, malafide and with a willful motive to teach a lesson to the RTI Activist. The DEO Ajmer office has in fact reacted to the misfeasance (meaning: the wrongful and injurious exercise of lawful authority) conducted by the office of DEO Ajmer for which Consumer Forum had penalised it.
The law also forbids the public authorities to act on mere a minor incident in the office. The Public Authorities are required to inquire into the matter impartially, giving equal opportunity to both the rival parties; and based on the inquiry report, if prima-facie any action is warranted, should proceed against the delinquents as per law.
The present tangle is also raised as Mr. Tarun had reported to be trying to expose the corruption and the officials who were late in resuming their duties.
1. A brief and fair official enquiry be conducted in the matter.
2. The receipt of a RTI Application/Appeal of Mr. Tarun, which he came to deliver by hand, is the testimony that he went to the office of DEO in connection with the business under Right to Information Act 2005.
3. The action, if any, taken by Mr. Tarun in "good faith" under the Right to Information Act 2005 cannot be taken any cognizance of by the Police which prohibit to any such action under Section 21 of the Right to Information Act 2005, since, "No suit, prosecution or other legal proceeding shall lie against any person for anything which is in good faith done or intended to be done under this Act or any rule made thereunder".
4. Mr. Tarun is a RTI Activist and Whistle Blowers and required to be provided security. as provided by Govt. of Punjab, Haryana, Chandigarh and Maharashtra etc. for the protection of RTI Activist etc.
5. The matter is under strict watch of the Activists from the whole of India, and any misfeasance will attract a swear reaction.

Subject : FIR registered on a RTI Activist Mr. Tarun Agrawal by DEO Ajmer.
Dear Sir,
Humbly submitted that DEO Ajmer ordered to register FIR against one RTI Activist Mr. Tarun Agrawal aleging misbehavior with a female staff of DEO Office. Mr. Tarun is exposing irregularities and corruption in various departments and offices including office of DEO. In one case DEO Ajmer also penalised by Consumer Forum Ajmer. In one case DEO Ajmer also penalised by Consumer Forum Ajmer. Incidents occured when acting on complaint of late arrival of staff at DEO Office Mr. Tarun was taking photograph of inside of DEO office, one lady staff thrown some files and alleged misbehaviour by Mr. Tarun. Acting on Tit for Tat DEO Ajmer with the help of a lady staff become success to fight against Mr. Tarun. This is very shamless and illegal way adopted by DEO and I strongly oppose such illegal way adopted by DEO Ajmer. Please see enclosed file for the reference.
PRAYER :
1. A brief and fair enquiry on the matter.
2. Quashed of such false FIR registered against RTI Activist Mr. Tarun Agrawal which is not allowed under Section 21 of RTI Act 2005 for any action taken on good faith.
3. Provide security to RTI Activist and Whisley Blowers in the state by making a fair Policy for that purpose as adopted by Govt. of Punjab, Haryana, Chandigarh and Maharashtra etc. for the protection of RTI Activist etc.
4. As the case is under watch of the Activists from the whole of India, so please ensure justice and avoid any injustice.
