If the CBI does not challenge this decision in HC/ SC, there will not be any need to file any other case in the the HC challenging the Govt. decision exempting the CBI from the purview of RTI.  If the CBI challenges this decision, citizens should can also be plead to be made a party along with CIC for defending CIC.  This is an important case of the civil society and the legal lumanaries and PIL expert Mr. Prashant Bhushan for defending the CIC's decision. He may offer to fight this case on behalf of CIC, even if the CIC pays less fee than fixed by him.

Attached is a very good and well reasoned order delivered by Mr. Shailesh Gandhi pertaining to CBI.  I feel Mr.Shailesh has consistently maintained the true spirit of RTI in all his orders and upholding the objective of transparency as paramount . It is sad that many things were said about Mr. Shailesh Gandhi's orders like calling them inconsistent with the Act, etc and surprisingly some of these activists were international award winners who constantly harped on their set agenda "to PENALISE PIOs". Wonder where these "penalise PIOs agenda activists"  were when Delhi High Court cancelled or reduced penalty amounts. They  did not have guts to say anything against the High Court decision nor did they proceed against the High Court order legally. For many so-called activists,  it is easy to blame and find fault rather than participate in the system. In fact, nobody wishes to follow up on  "to do" in the orders given by ICs and yet have the audacity to just sit and find mistakes, which undoubtedly is an easy task for them.

Reports indicate that SG is exemplary, because he is:
a) the highest penaliser in the country,
b) the IC who has disposed off the highest number of Appeals and Complaints in the country,
c) the IC who has given the maximum directions to PAs for Section 4 disclosures  and implementation
d) the IC who has been keeping a systematic  track of whether his orders were complied with or not
e) the only IC convening meetings on his own to interact with NGOs, Citizens, CBO, RWAs etc on specific agenda ( not individual issues).
As per to survey appellants are also not unhappy with the appeal proceedings.

I strongly feel that if we all don't take advantage of this order given by SG and which can be the base for our contentions that CBI should not be included in Schdule II of RTI act,  we may in the near futures find Local police, Anti Corruption department, PA Vigilance department etc also included in Schedule II. It is, therefore, necessary for all of us to  wtrite letters to PM, DoPT, all concerned depts citing this Order of IC SG and demanding removal of the CBI from Schedule II
