Re: [IAC#RG] In the matter of "Gory sexual assault by retired SC judge"

Dear Naishadh

New Year greetings to yourself.
I'm hardly involved in these elections which are going on expected lines.

From what I can make out in this Stella James matter some incidents did take place, either in actuality or in the mind of the victim, which she wants to bring into public domain but not to prosecute. That is her prerogative surely, irrespective if the perpetrator is a judge or not. from what I recall of the IPC there was a legal bar against anyone other than the victim or some close relative bringing it to the cops.

Its very well known that some judges and senior advocates cannot control their libidos and there is nothing that can be done against them because the evidence is made to disappear or the complainants are turned. This happened when I went after Abhishek Singhvi's video-romp from the CPIO  of the Supreme Court In fact there are loads of these "creepy" old seniors handing around the corridors of the SC and the High Court going and patting / feeling up the pretty lady interns and juniors quite openly - 'beti  kaise ho'.

After Singhvi-kaand, such scandals have advanced so much that the judges "fraternities" are now keeping it within themselves, like hilly-billys.

Dear Sarabjit,
Greetings in the new year.

Keep up the good job. I thought you are more engaged in election rally heat but I am gla to see this post.

Personally, I believe that instead of inquiry, immediate registering of FIR ought to have been proper. No arrests needed. zero numbered FIR for any geographic jurisdiction. If found to be a false complaint, the persons found in police criminal investigation involved in false complaint can be booked. If needed, summery report may be filed for closer of FIR by court.

FIR would have not given scope to sponsored applicants like Dr. Nutan for application u/s 156 (3) to Lacknau CJM; casting aspersion of shallow judicial inquiry without immediately registering FIR! http://bhadas4media.com/state/up/lucknow/15852-2013-11-16-13-00-30.html

What can you do to this applicant Dr. Nutan, who is applying before court on the basis of "no trust in inquiry" and "demanding compliance to SC citation"!?! See Para 3, 10, 11, 12,  15, 16 of application of Dr. Nutan. These could have been averted.

SC is the most revered institution of our country and all must give utmost respect - no exception.

best regards,

IAC was appalled to read in the ToI today some really offensive statements that the Petitioner in the case (ML Sharma) is purported to have made against ladies.

"He added that he has "learnt through ancient books which has already disclosed and established several times that (a) lady never speak (the) truth. Even for a short benefit or for revenge for denial (of) her demand she can go up to any extent for revenge. No one can control her revenge/greed. Upon disclosure of truth she puts herself as a poor helpless in the world. All empires and fight happened due to her ego and greed (sic).""

IAC promptly contacted Adv. Sharma to confirm if he had filed such rotten things, and if so IAC would intervene before the Court to defend the nation's ladies from the likes of him.

To his credit, Adv Sharma replied back promptly explaining  that a journalist had further  circulated an old preliminary draft (usually given in advance to them to prepare questions for a TV interview). He has provided IAC a soft copy of the final writ as filed (subject to registry objections and corrections) by him which is attached.

IAC agrees with Sharma that the evidence must be placed in public domain, such as on the website of the SC to "name them and shame them". The role of the Attorney General is once again quite dubious if what ML Sharma says is true.

The identity of the judge has been pinned down, all it requires now is for the lady to say it.
