Respected Sir,

I want to draw your kind attention regarding the matter of police inaction and harassment committed by the perpetrator police personnel of Bhagwangola Police Station, District-Murshidabad, West Bengal in the matter of immoral trafficking of a minor girl named Ms. Sakina Parveen(name changed) who is aged about 16 years(Date of birth-10.2.1996) only. The perpetrator police personnel of the said police station did not take any action till date to rescue the victim girl. It is alleged that the police intentionally delayed to register complaint in this matter and no action has been taken against the accused persons till date allegedly involved in the immoral trafficking of the victim girl.

The police only discharged duty by registering one First Information Report on the basis of the complaint made by the family of the victim girl. Repeated requests made by the victim's family to take action had gone into the deaf ears of the police. The mother of the victim lodged written complaint before the Superintendent of Police, Murshidabad informing the whole incident of harassment upon them and inaction by the perpetrator police personnel of Bhagawangola Police Station, but here also the higher authorities of police are insensitive to look into the matter. Our attached fact finding report gives the details of the whole incident.   

Hence we seek your urgent intervention regarding this matter in following way:-

·       The whole incident must be investigated by the Commission's own investigating wing.

·       The minor victim girl must be rescued immediately and appropriate legal action must be taken against the accused persons involved in this incident and they have to be booked under the Immoral Traffic (Prevention) Act.

·       The role of the perpetrator police personnel of Bhagwangola Police Station must be investigated neutrally regarding their alleged inaction and omission to discharge lawful duty in this matter and they must be booked under the law for their illegal acts.

Name of the victim: - Ms. Sakina Parveen (name changed), aged about- 16 years (Date of birth-10.2.1996), by faith- Muslim, residing at village- Naharpara, Police Station-Bhagwangola, District-Murshidabad, West Bengal, India.

Name of the perpetrator: - The Officer-in-Charge and the other involved police personnel of Bhagwangola Police Station, Murshidabad.  

Date of the incident: - On 8.11.2012 and subsequent thereafter.

Case details: -

It is revealed during fact finding that the victim girl was a student in class-VII at Naharpara M. S. K. School. On and from 8.11.2012 the victim girl went untraced. The parents of the victim tried to find out her whereabouts but they could not find their daughter. After that they came to know Mr. Mantu Sheikh, son of Mr. Ayub Ali and Mr. Jullu Rahman, son of Mr. Lubur Sheikh, residing at village-Naharpara, Police Station-Bhagwangola, District-Murshidabad kidnapped the victim girl by luring her to marriage. The victim's family apprehended that she had been trafficked by the said persons with intention to put her into flesh trade. The parents of the victim girl lodged complaint at Bhagwangola Police Station on 9.11.2012 but the police only recorded one General Diary Entry vide 480/2012 dated 9.11.2012.  But the police did not take any action on the matter. Due to inaction of police the mother of the victim girl filed one court complaint (Memo no. 1660/2012) under section 156(3) of Criminal Procedure Code at the Additional Chief Judicial Magistrate Court, Lalbagh against Mr. Mantu Sheikh and Mr. Jullu Rahman bringing allegations of immoral trafficking of the victim against them. The court allowed the petition and sent the same to Bhagwangola Police Station for treating the complaint as First Information Report and to investigate. Then the police of Bhagwangola Police Station registered one First Information Report vide Bhagwangola Police Station Case no.388/2012 dated 12.11.2012 under sections 363/365/372 of Indian Penal Code. But the police again did not take any action to rescue the victim girl till date and the accused persons are roaming freely.

The mother of the victim sent written complaints through the registered post to the Superintendent of Police, Murshidabad and the Sub-Divisional Police Officer, Lalbagh informing the whole incident of harassment upon them and inaction by the perpetrator police personnel of Bhagwangola Police Station. The mother of the victim girl stated before our fact finding team that on 15.1.2013 she personally met with the Superintendent of Police, Murshidabad and the Sub-Divisional Police Officer, Lalbagh and requested them to take legal action in the matter of her daughter. But till date no action has been taken by the higher authorities of police. The family of the victim girl ran from pillar to post of the administration and police but all their efforts went into vain. The victim's mother told that the police are reluctant to take any step due to her poor and marginalized condition. She also stated that the police are silent to take any action against the accused persons even being aware that the accused persons are involved in immoral trafficking in the locality.

On 19.5.2013 our fact finding team contacted with the Officer-in-Charge of Bhagwangola Police Station and also the Investigation Officer of Bhagwangola Police Station Case no.388/2012 but they refused to talk on the matter of the victim girl.
