As it is the Central and State Governments treat the ICs post as a post retirement benefit.
Does post-retirement benefit also have quota ?

Quota for information commissioners' posts?

MUMBAI: The Maharashtra government has sought legal opinion on whether the posts of state information commissioners can be reserved for people from backward classes.

According to sources, the state general administration department (GAD) has approached the law and judiciary department for an opinion in this regard.

The commissioners perform the task of addressing address complaints and appeals from RTI applicants. The state information commission (SIC) has eight posts for information commissioners. One of these is the post of the chief information commissioner.

The others are posts for information commissioners in various divisional offices of the SIC, including Mumbai, Pune, Konkan, Amravati, Nashik, Nagpur and Aurangabad.

While the posts have been in existence since 2005, the GAD has now sought an opinion regarding introduction of reservations for these posts.

Reliable sources indicated that the reservation exercise was being endorsed to facilitate the appointment of a recently retired IAS officer as an information commissioner. A senior state official even said that the retired IAS officer was being considered for the post of the chief information commissioner (CIC) since July this year, when the then CIC Vilas Patil retired.

In the absence of a full-time CIC, Vijay Kuvalekar, information commissioner, Pune bench, has taken over as acting CIC. It was expected that Kuvalekar would soon be appointed as a full-fledged CIC. This development, however, has given the appointment saga a new twist.

Besides the CIC's post, the post of information commissioner for Mumbai and Konkan divisions are lying vacant. Ramanand Tiwari, who was the information commissioner for Mumbai division, was suspended after his name cropped up in the Adarsh housing society scam, while Navin Kumar, the information commissioner for Konkan division retired in August this year. The law and judiciary department is yet to submit an opinion.
