Dear All,
Enclosed documents in Maharashtra Elektrosmelt Limited - Steel Authority of India Limited Merger Petition being heard by Ministry of Corporate Affairs GOI New Delhi is for your kind perusal.
My primary objection is that the Govt Officers are not authorised to hear and approve Govt PSU Mergers that are operated under Companies Act 1956.
They are also not suited to discharge judicial function involving Constitutional & Legal Complexities.
My other crucial contention is that any citizen, irrespective of whether he / she is a shareholder of the Govt Companies being merged or not, is entitled to support or oppose the Merger of Govt Companies since public money is involved unlike other Companies in which Shareholder money is involved.
The way High Courts hear and approve other Company Mergers of the Companies operated under Companies Act 1956, High Courts only should hear and approve Govt Companies.
Govt has wrongly taken over the judicial function since 1978 that has been legally challenged but not decided by Higher Judiciary.
Govt must stop hearing & approving Govt Company Mergers involving thousands of crores of public money.
Wrongly merged Govt Companies also be de-merged.
In my considered openion, any citizen is also entitled to witness the public hearing at MCA GoI New Delhi.

Dear Sir,
Further to my preliminary objections filed on 16th February 2011; oral submissions made during hearing on 8th March 2011; written submissions filed on 10th March 2011; reply filed by the Advocates of the Petitioner Companies dated 15th March 2011 and letter dated 4th April 2011 by US MCA New Delhi, I hereby submit rejoinder dated 10th April 2011 well before the due date of submission viz 15th April 2011. The same may kindly be acknowledged.
Reasoned order may kindly be pronounced in the Open Court on 18th April 2011 - the next date of hearing - or during the hearing thereafter, if it is decided to defer pronouncing the order.
Copy of the Order so passed may kindly be expeditiously served on all the concerned.
