What An Idea Sir ji , You are suggesting a Great Ammendement to RTI act 2005 . Please read the preamble of the act and If You can access read about the idea /Ideals of thia ACt . then you will come to known about your "independence" and "independent officers" . Already the RTI Act 2005 in several clauses has provided for all these to the PIOs and If available and Not being Utilised , it is duty of every citizen to ensure that it is used . Your suggestion is like if you have Cold & sneezing , Cut the nose and everything will be alright Freinds , Discussions Should neccassarly revolve around What is available . It is Now become the english saying " A Bird in hand is Worth two in Bush" . Of late i Observe that Members on board Especially New members Come and write on board and start discussions which are beyond the scope and perview of the Act Let us exibit our Maturity in Discussions SIR , AS SUGGESTED BY YOU IF THE PIO HAS AN INDEPENDENT OFFICE NO GOVERNMENT OFFICER OR PUBLIC SERVANT WILL GO VOLUNTARILY OR OBLIGATORLY OR COMPOLUSORLY AND HAND OVER OR EVEN SAY TO AN INDEPENDENT PIO OF WHAT DOCUMENTS HE POSSES AND WILL PART WITH . TO CREATE SUCH AN INDEPENDENT PIO AND INDEPENDENT OFFICE TO PIO , THE CONSTITUTION HAS TO BE AMMENDED. EVEN IF JUDICIARY IS INDEPENDENT WING IT IS IN THE AMBIT OF RTI AND OPEN TO RTI

PIOs are departmental persons and they are always trying hard to protect their officers in not giving the information.
All the PIOs should be independent officers and they should have independent office. Similar should be the case with elections officers and its staff. Election staff is also a deputed staff and it is influenced by the government. No deputation should be permitted for an independent wing. Independent wings should have their own staff just like judiciary.

sir i agree with you that problems are created by PIOs. your approach is OK for starters. but I make sure the PIO read the Act and act accordingly and nothing else. this is important to force babus change their habits of arrogance. beniwal

Capt beniwal, Several new RTI applicants are facing the problem of improper filing of application, which is a pretext for the PIO to avoid furnishing of information.And these silly mistakes are being entertained by the information commissioners by not punishing the culprits.And also, this is taking months of time to reach to that stage of hearing the cases in front of the information commission, mean while the applicants are getting frustrated.Why to give a chance to the culprits by improperly filing the application by the new applicants?, to avoid this we are asking the applicants to fallow the application format.This is giving positive results.

To: humjanenge@googlegroups.com Date: Sunday, 28 August, 2011, 11:30 PM Dear Rahul, Under RTI application there are some compulsory pre requisites, fallow them; 1)RTI applicant should fallow the RTI application format (see the attachment) 2)From the date of application, wait for 30 days for reply, if there is no response from PIO, 3)Apply the same to the higher authority with in the same department file an application to the First appellate along with the xerox copy of the acknowledgement, and wait for 30 days, if there is no response from first appellate then, 4) File the same to the Second appellate, the Karnataka state information commission along with the xerox copies of the acknowledgement.
