Perhaps a more important issue is not if he is an officer, or a clerk, but :
  1. What is the job description of the person,
  2. Was he trained/instructed in his job functions, roles and duties, if yes than was there a record of the same, f not then his superior is responsible for this dereliction of duty
  3. Did he do the job, as per his instructions/training
  4. etc.
I think unless the whole chain is fixed to perform, we can keep playing the blame game. No improvement/change will take place.

Dear Shri Roy:

I have never served as an employee or an Officer of the GOI but have over the decades collaborated with Govt. Deptts. and Ministries from outside.

My information is that an UDC is an upper division clerk., and is NOT an Officer.

With regards.

Will some enlightened person well versed in functioning of Govt inform me of
a UDC (upper division clerk) is an "officer" or not (for purposes of 5.4 and 5.5
of RTI Act). I thought that they are classifed as "employees".
