WHEN WILL THE SOLDIERS GET JUSTICE?
 
Hon'ble Prime Minister of India,
 
1. We, the defence veterans have taken up numerous cases of injustice to the defence personnel, with you RM and other functionaries of the Govt with little or no positive outcome. Such an apathetic attitude towards the soldiers by the Government is not understood? A few instances of injustice:-
 
(a)                   Supreme Court Judgments have either not been implemented or have not been implemented in letter and spirit of the court in the cases of:-
 
(i)      Disability pensions
 
     (ii) Payment of arrears with effect from 01-01-2006 instead of  24 Sep 2012
 
   (iii) Non implementation of judgment in Rank Pay Case
 
   (iv) Non-reimbursement of Hospital charges on authorised ECHS   rates for medical treatment abroad,.
(b)  Over 3000 cases decided in favour of defence personnel by AFTs have not been implemented; on the contrary, all these judgments have been contested in Supreme Court by the MoD to delay justice. Mr. Prime Minister, imagine the plight of a widow of a Sepoy, living in a far flung rural area who had won the case from the AFT and MoD files SLP in SC. How is she going to find the resources to fight her case in the SC?
AFTs were created for speedy justice at economical cost to the Defence personnel. The way MoD has proceeded with the AFT's judgments, has not only delayed the justice but also made it near impossible for the defence personnel to fight these cases in the SC.AFTs have not been given civil contempt powers to get their judgments implemented while these powers are available with the CATs. What a travesty of justice?
 
(c)          A sepoy who is being compulsorily retired after 15/17 years of service is being denied the benefit of three career progressions guaranteed by the 6th CPC. While civilian Govt employees serve till 60 years of age and get the benefits of all three promotions, why has the same been denied to a sepoy? Our representation that a sepoy who is being compulsorily retired at 15/17 years of service must get the benefit of three promotions by granting him pension of a Nb Sub of 15/17 year service has not yet been accepted.
 
(d) A defence widow gets Rs 3500 per month (minimum pension).The minimum wage of an unskilled labourer in Delhi is Rs 8300 per month. Our request to enhance the minimum pension of a defence widow to Rs 10000 per month has not yet been accepted.
 
(e)        You are aware that defence personnel die earlier than their civilian counterparts. This had been revealed by a study carried out during the 5th CPC. The study revealed that while the age expectancy of the civilian employees is 77-78 years that of the defence personnel is as under:-
(i)    Other Ranks-59.6 to 64 years.
(ii)   JCOs-67 years.
(iii)  Officers-72.5 years.
This serious issue was raised in the Parliament and the then RM Mr. Pranab Mukherjee had stated, that this matter would be attended to on priority. Over 8 years have passed, no tangible measures have been initiated to address this serious issue of National Security.
 
(f)   While the pensions of all other ranks were enhanced with effect from24 Sep 2012 to redress the anomaly of 6th CPC, the JCOs ranks have not been granted the enhancement. Our request to enhance their pensions proportionately has not been accepted.
(g)          Majors with 13 years' service and above who retired prior to 2004 have been denied the benefit of the rank of Lt Col ie (pension in PB-4 Band).The Govt policy to grant Lt Col rank with 13 years of service was made applicable with effect from 2004.To meet the ends of justice, all Majors who retired prior to 2004 with 13 years of commissioned service (this number being finite) should have been granted the benefit of pension of Lt Col. Our strong plea in this regard has not been accepted.
 
(h)           Defence personnel who get disability during service are medically Boarded out with no/limited disability pension, while a disabled civilian employee is kept in the service till the age of 60 years and also given his three authorised promotions. Our request to give assured alternate Govt job till the age of 60 years to the disabled soldiers who cannot be retained on active military service along with three promotions and pension thereafter, has not yet been accepted.
 
(j) Our legitimate demand of assured second career to the defence personnel till the age of 60 years through an Act of Parliament has not yet been accepted.
 
(k)          Non Functional Upgrade (NFU) granted to civilian employees has been denied to defence personnel thereby putting them at disadvantage vis-a-vis their civilian counterparts. Our request to grant the same to def personnel has not been accepted.
 
(l) One Rank One Pension (OROP), inspite of strong recommendations by various Parliamentary Committees and petition Committee of Rajya Sabha, has not yet been granted.
 
(m) Prior to 2006, the gap of pay between Major General and Lt General was only Rs 1400 per month and consequently the gap in pension was only Rs 700.Consequent to creation of HAG and HAG+ for Lt Gen and above, the gap in pension is more than Rs 8000 even after the increase wef 24 Sep 2012.The Govt has overlooked the 6th CPC recommendation, where in, all the Govt employees with basic pay of Rs 20000 and above were to be clubbed in the same One Pay Band. All Major Gens retire at Basic Pay of Rs 22400 and above while the Lt Gen retired above Rs 23500 basic. Non-inclusion of Major Generals in HAG has caused this unacceptable gap which is a grave injustice and needs to be corrected immediately.
                                                                                   
(n) The fact that contempt notice has been issued by the SC to 4 senior functionaries of MoD for non-implementation of SC judgment in Rank Pay case reveals the magnitude of injustice to the defence personnel.
 
(o)           Despite losing the case in CAT/AFT, HC or SC, the MoD, a review petition has been filed by the MoD in SC denying arrear of enhancement of pension wef 01-01-2006 instead of 24 -09-2012.Why this review petition to deny the benefit to its employee, is not understood and is a grave injustice.
 
(p) Civilian Employees are provided medical treatment under CGHS Scheme while the ESM are covered under ECHS. The provision of budget for CGHS is being calculated (for 2013-2014) at rate
Rs 10,700 per beneficiary while for ECHS, it has been budgeted at Rs 3,150 per beneficiary resulting in super-speciality hospital not offering themselves for ECHS empanelment. And those that got empanelled, over 80% have withdrawn from the empanelment for non payment of their bills and also due to inadequate rates for various procedures. This is resulting in unsatisfactory or poor medical care/ treatment of ESM. The latest and technically advanced procedures have not been included in the ECHS procedures. Our request to include all procedures which have been introduced in the country for six months in the ECHS procedures list to make available the latest treatment to defence veterans has not yet been accepted. The budget must also be enhanced and must not be less than the CGHS rates for the year. Our request in this regard has not yet been accepted.
 
3. Mr Prime Minister, the list of injustices is endless. Our letters addressed to you and RM are not being put up to you for your and the RM's personal intervention but are forwarded by lower functionary of PMO/ RM office to the department of MoD for action and information to us. Our numerous requests that letters addressed by name to the PM and RM must be seen by them and their reply must have the approval of PM/RM have gone unactioned. It seems that none of our letters on the above issues have been seen by you, leave alone taking any positive action.
4.    You are requested to grant us a meeting for an hour to our delegation of 5 Ex-Servicemen at your convenient date and time to enable us to brief you in person so that positive measures can be initiated by the Govt under your directions to redress all the above issue.
