Now all the PIO's may refer the applications to their Legal opinion with the Govt money & can escape from their penalty.

There remains the question of penalty. CPIO Shri A. N. Das was asked why he should not be held liable, in response to which he has stated that he has simply acted on the advice of the Legal Advisor and, therefore, no malafide can be attributed. On this ground, we cannot come to the conclusion that, although the information provided is indeed, as we have found, incorrect and misleading, this was "knowingly" so provided. Therefore, there will be no penalty.
