CBEC works under department of revenue , ministry of finance ,
government of India.
CBEC is not in second schedule and so section 24 does not apply to this at all.
requesting information regarding an Additional Commissioner,though
presently posted in DRI ( an organization included in second schedule
) does not mean all RTI queries related to the official should be sent
to the office of his latest posting. RTI query should have been
transferred to the CPIO of concerned PA which holds the info that was
asked. I presume the official is from INDIAN REVENUE SERVICES
The points of RTI application which were transferred u/s 6(3) by CPIO,
CBEC to DRI are stated to be :
xi. Details of training (including overseas) undergone by G.
Sreenivasa Rao till the date CPIO is replying to the RTI application;
xii. Total amount of reward received by him in his career so far;
xiii. Number of accounts (Savings, Current, Recurring Fixed, PPF and
any other type), opened by G. Sreenivasa Rao after joining service as
per available records in CBEC;
xiv. Names of the Branches of the Banks with the addresses where
accounts mentioned in point (xiii) have been opened by him after
joining service;
this is a case of wrong transfer of RTI petition
The info asked should be available with the ministry of finance ,
ministry of foreign affairs and DOPT .
so far as point no. XIII & XIV are concerned , i am of the view that u
shall get the part of info that is mandated under rule 16(2) of All
India Services conduct rules 1968.
bank a/c details are personal info and is generally not kept by the PA
, so can not be obtained under RTI.
if U have specific reliable info of black money , try the complaint n
then the RTI route abt ur complaint..
or else , for this case move appeal to the AA of CBEC .
