As you are well aware through series of my emails highlighting on Govt Agencies like PMO; President of India Secretariat; DoPT & PIOs / FAAs & Information Commissioners encroaching upon fundamental right - Freedom of Expression - by sinister efforts such as:
- Without any justifiable reasons, making provision of only ten ICs at CIC and State CICs that is awfully insufficient.
- Arbitrary, illegal, undemocratic and secretive selection & appointment of ICs / CICs to post the pliable persons.
- Posting only the general category persons as CICs & ICs seriously compromising the Affirmative Action stipulated in the Constitution.
- Posting of primarily the Bureaucrats as CICs & ICs seriously violating the fundamental right to equality guaranteed in the Constitution.
- Not providing any time limit for ICs to hear & dispose off RTI second appeals / RTI complaints for them to abuse undue discretionary power.
- Not putting the system in place for timely implementation of Orders issued by the ICs to disclose information.
- Not penalising the intentionally defaulting PIOs with disciplinary action.
- Knowingly creating these types of bottle-necks to ensure that the requested RTI information is not disclosed.
- Ignoring the repeated pleas of the civil society for taking corrective actions to avoid things going totally out of control.
- Harassing, torturing, threatening, chargesheeting, suspending, victmising and even murdering the RTI Activists to discourage them from using RTI.
- Now, the new trend to dissuade RTI Activists has started is getting them entangled in legal cases by wasting public money by highly resourceful authorities wielding enormous power.
That being the case and legal fight being fought between two un-equals, principle of natural justice demand that the RTI Activists, having very limited resources financially or otherwise, by statutory provisions, must be provided Free Legal Aid by the Govt to defend themselves against the mighty power acting in a high-handed manner.
