[rti_india] Mr Kashinath Sahoo - Commissioner-Cum-Secretary Orissa Information Commission - How many defaulting PIOs NOT penalised and let off?

Dear Sir,

Kindly refer to the email, placed below, that I have received from your end.

In this regard, for objectivity to prevail over the subjectivity of absolute figures, I shall be grateful if you can kindly inform me:

• No. of PIOs who were found defaulters & deserved to be penalised but were not penalised by Orissa Information Commissioners & let off.
  
  
• Percentage of PIOs, out of total, who were found defaulters & deserved to be penalised but were not penalised by Orissa Information Commissioners & let off.
  
  
• No. of PIOs who were found defaulters & only financially penalised but Orissa Information Commissioners did not direct their higher ups to make entry of it in their Performance Appraisals and not directed their higher ups to initiate disciplinary actions against them.

        I am directed to say that the Orissa Information Commission has gone through the contents of the e-mail message to Jogesh@Samarthan.org with copy to other e-mail addressee. The sentence which reads as "as a public institution nearly 5 years of time, they have hardly penalized/fined a PIO in any case sofar" is not based on facts. Here it may be pointed out that the Orissa Information Commission is a quasi judicial body and all their orders have been hosted in the website since inception.  During the period of last 4 and half years of the working of the State Commission, 245 PIOs have been penalized amounting to ` 28,79,500/-.  Of them 61 PIOs have been penalized with the maximum penalty of ` 25,000/- each.  As such, it is not a fact that none of the PIOs have been penalized so far.  The State Information Commission would appreciate constructive suggestions from the civil society members like you in the interest of implemention of provision of RTI Act,2005 and Orissa Rules framed thereunder.  (The Rules differ from State to State in the Country).
