Kindly refer to on going correspondence in the subject RTI application with the matter pending with Ms Shalini Darbar, Director, CVC, New Delhi since 10th September 2010.

In response to my RTI application dated 31st March 2010, I have received 56 (Fifty Six) replies from different CPIOs of CBI from all over India conveying NIL information, the crucial matter as to who is the correct CPIO (s) of CBI in whose administrative jurisdiction the requested information is available has yet not been settled.

Kindly advise Ms Shalini Darbar to look into and confirm the above for my suitably taking up the matter with the concerned officer for already overdelayed RTI information requested in larger public interest..

In the light of the on going communications, I hereby lodge complaint against Mr H C Awasthy of CBI, RTI First Appellate Authority in RTI Ref bdvcbi2, for not deciding himself on the appeal; allowing some other unauthorised Officer to  reply; dereliction of duty and unbecoming of an Officer.

Kindly arrange to initiate disciplinary action against him.

MHA be advised to kindly keep me informed of action taken

As per letter dated 22nd June 2010, you are the First Appellate Authority; I have filed first RTI appeal to you on 28th June 2010 and I am entitled to disposal of the RTI first appeal by you (Mr Mr H C Awasthy, HOZ / AC, CBI ) and neither Ms Tilotama Verma nor anyone else is entitled / empowered to decide on my RTI first appeal filed to you. I am, therefore, ignoring the letter written by Ms Tilotama Verma on 9th July 2010.

This has reference to my below placed RTI application Ref bdvcbi2 dated 31st March 2010 and  CBI letter no. 267/5/DIG/AC.1/RTI/2010/54 Dated 22nd June 2010 received by the undersigned RTI applicant on 26th June 2010.

In this regard, I wish to inform as under:
  • RTI application was made on 31st March 2010 & the requested information should have been furnished within 30 days or denied within the same stipulated period specifying the reasons for refusing to disclose the requested information while also quoting the relevant Clause of the Right to Information Act 2005 under which the requested information is refused to disclose.

  • Same has not happened in this case, the requested information has not been furnished / has been denied after nearly three months and that too after raising the matter to Director, CBI level to expedite the RTI information. 

  • On perusal of the above-mentioned letter of Mr Rakesh Aggarwal, Dy. Inspector General of Police, CBI, AC.1, New Delhi, it is not clear whether he is the PIO for AC.1 CBI New Delhi and has replied in his capacity as PIO for AC.1 CBI New Delhi

  • It is also not clear whether he is the concerned, the correct & the only PIO of CBI holding the requested information or other PIO (s) has / have the requested information in their possession.

  • Denial of information, conveying that the information be treated as NIL, has been by an unreasoned order as nothing has been specified as to why the information is to be treated as NIL.

  • In fact, looking at the information requested, PIO saying "NIL" information does not mean anything without explaining what it means. 

  • The relevant Clause of the Right to Information Act 2005, under which the requested RTI information can be legally denied on valid ground, has also not been quoted by Mr Rakesh Aggarwal while conveying that the information be treated as NIL. 

  • This is also serious violation of the Right to Information Act 2005 when provided for it in the Act and umpteen no. of CIC Judgements have amply made it clear it but still CBI has preferred to knowingly violate it after operating the Act for the last nearly five years. 

  • The time-limit within which the First Appeal is to be made has not been mentioned though necessarily required.

In view of the above, the First Appellate Authority mentioned in the said letter dated 22nd June 2010 is requested to kindly:

  • Direct Mr Rakesh Aggarwal Dy. Inspector General of Police, CBI, AC.1, New Delhi to disclose the requested information, per return, free of cost since delayed beyond 30 days, if he is the PIO as also the correct / concerned & the only PIO holding the requested information.

  • If Mr Rakesh Aggarwal Dy. Inspector General of Police, CBI, AC.1, New Delhi is one of the PIOs holding the requested information, alongwith other PIO (s) of CBI, the RTI application be transferred to him / her / them with a direction to disclose the information, per return, free of charge.

  • If Mr Rakesh Aggarwal Dy. Inspector General of Police, CBI, AC.1, New Delhi is not the correct & the concerned PIO holding the requested information, he should be requested to explain the reasons for refusing information on invalid & unjustified ground and without quoting the relevant RTI Clause. 

You are requested to kindly acknowledge receipt of this First Appeal made under RTI, through electronic mode, within the stipulated period, preferably by email or even by snail mail. 

Requested RTI information, requested in larger public interest of curbing the corruption / transfer of ill-gotten money by people in power at national level, be furnished without further loss of time so that the same can be put to use for corrective actions possible. 

That should reflect the seriousness of the premier investigating agency in helping the suffering masses due to rampant high level corruption swallowing public money.

That should also reflect the sincerity of CBI in improving its much needed credibility among the people at large and  also among the world community.

Dear Sir,

Following information is requested under the Right to Information Act 2005 in larger public interest of transparency & accountability in the public administration towards the citizens as envisaged in the Act. While seeking this information, I wish to emphasise that the information that cannot be denied to the Parliament cannot be denied to an RTI applicant also.

The information requested pertains to the media news on the unaccounted money, by siphoning off funds by corruption, flew out of the country and efforts made by the Govt in bringing back the money that legitimately belongs to the citizens of India. RTI information is requested from CBI only based on the information that is available with the Central Bureau of Investigation / other Govt. Agencies to which the CBI has access to. Information is sought about the prominent people in power in India who possibly may have bank accounts in other countries to park the unaccounted money.

Information requested is as under:

  1. Name (s) of the countries in which Smt Sonia Gandhi has bank account (s), date of opening the first bank account overseas and the date on which the last money transaction took place.

  2. Name (s) of the countries in which Shri Rahul Gandhi has bank account (s), date of opening the first bank account overseas and the date on which the last money transaction took place.

  3. Name (s) of the countries in which Shri P Chidambaram has bank account (s), date of opening the first bank account overseas and the date on which the last money transaction took place.

  4. Name (s) of the countries in which Shri Pranab Mukherjee has bank account (s), date of opening the first bank account overseas and the date on which the last money transaction took place.

  5. Name (s) of the countries in which Dr Montek Singh Ahluwalia has bank account (s), date of opening the first bank account overseas and the date on which the last money transaction took place.

  6. Name (s) of the countries in which Shri Kapil Sibal has bank account (s), date of opening the first bank account overseas and the date on which the last money transaction took place.

  7. Name (s) of the countries in which Shri Ahmed Patel has bank account (s), date of opening the first bank account overseas and the date on which the last money transaction took place.

  8. Name (s) of the countries in which Smt Ambika Soni has bank account (s), date of opening the first bank account overseas and the date on which the last money transaction took place.

Kindly refer to my RTI application no. bdvcbi1 to CBI New Delhi, on the on going corruption case by CBI against Shri Murli Deora in Kerosene Marker purchase handled by CBI Mumbai, that was, in a funny way, transferred to CBI Jammu who informed me that the Right to Information Act 2005 was not applicable to the Sate of J&K. Kindly see that such reckless administrative manipulation in dealing with the RTI applications is not done by CBI hereafter.
